    Judge orders Oyster Bay to release documents to Newsday

    HICKSVILLE, NY (TIP): In what appears to be adding to the headache of Town of Oyster Bay, a New York State judge on Friday, July 8, ordered the Town of Oyster Bay to provide documents to Newsday in a ruling on Freedom of Information Law and Open Meeting Law requests.

    State Supreme Court Judge Leonard Steinman in Mineola ruled that Oyster Bay must turn over documents in seven FOIL requests and must certify that it has completely fulfilled two requests. The judge ordered a hearing on two FOIL and three Open Meetings Law requests that he did not rule on.

    “It is in the general public’s significant interest that Newsday be permitted to conduct the news investigation it is attempting to pursue by examining public documents (or, at least, documents that should have been and now will be public),” Steinman wrote.

    Newsday alleged that Oyster Bay had violated FOIL and the Open Meetings Law when it refused to make documents available or certify that all documents had been provided in response to more than a dozen Newsday requests from December 2014 through February 2016.

    Robert Freeman, executive director of the state Committee on Open Government, said it was an important decision.

    “Most important was the fact that the judge was serious about the obligation of the government agency to meet the burden of defending secrecy,” Freeman said.

    Thomas Sabellico, Oyster Bay special counsel, said an appeal was likely, but not before the decision had been fully reviewed and the parties meet for a conference on Thursday.

    The requests covered financial, planning and contractual records for the town’s concessions agreements with indicted restaurateur Harendra Singh; other town contracts; financial disclosures of former Planning and Development   Commissioner Frederick Ippolito; access to Zoning Board of Appeals meeting minutes; building permits; a town report on complaints made by Massapequa resident Robert Ripp; backup material for town board meetings; and town financial records.

    Steinman awarded Newsday legal fees in an amount to be determined following the hearing.

    Oyster Bay argued in court filings that many documents could be withheld because of ongoing investigations or potential litigation.

    Steinman, however, ruled that this argument was without merit, pointing out that FOIL’s law enforcement exemption covers documents compiled specifically for investigations, not those that are produced in the normal course of business that may later become part of an investigation.

    UCI appoints Pramod Khargonekar Vice Chancellor for Research

    SACRAMENTO (TIP): U.C. Irvine announced that Pramod Khargonekar has assumed the role of vice chancellor for research at the university.

    The Indian American took over the role at U.C. Irvine June 30.

    In this position, he will provide strategic direction for the Office of Research, which supports and enhances the creative and scholarly activities of UCI faculty. His appointment by UCI Chancellor Howard Gillman comes after a comprehensive national search.

    “Pramod’s stellar career – as a researcher, educator and national leader – makes him an outstanding choice to lead our ambitious efforts to expand the scope and impact of our world-class research,” Gillman said. “He understands how science is evolving, the role of interdisciplinary coordination in addressing global and regional challenges, the important link between research and education, and the need to cultivate a broader innovation ecosystem.”

    Khargonekar has a varied background in federal and academic positions. He most recently served as assistant director for engineering at the National Science Foundation. While there, he headed the Directorate for Engineering, which invests in frontier engineering research and education, encourages a culture of innovation and develops the next generation of engineers. As a member of the NSF senior leadership and management team, Khargonekar also helped set priorities and policies and led or co-led major initiatives promoting inclusion and diversity in science and engineering, natural hazards research and engineering education. In addition, he is currently the Eckis Professor of Electrical & Computer Engineering at the University of Florida.

    Khargonekar earned a Bachelor of Technology degree in electrical engineering at Bombay’s Indian Institute of Technology in 1977 and an M.S. in mathematics and a Ph.D. in electrical engineering at the University of Florida in 1980 and 1981, respectively. He has held faculty positions at the University of Minnesota, the University of Michigan and the University of Florida. At Michigan, Khargonekar was chair of the Department of Electrical Engineering & Computer Science from 1997 to 2001 and also was the Claude E. Shannon Professor of Engineering Science. At Florida, he was dean of the College of Engineering from 2001 to 2009. In addition, he served as deputy director for technology at the U.S. Department of Energy’s Advanced Research Projects Agency-Energy.

    Khargonekar has received the NSF Presidential Young Investigator Award, the American Automatic Control Council’s Donald P. Eckman Award and O. Hugo Schuck Best Paper Award, Japan Society for the Promotion of Science fellowships, the Institute of Electrical & Electronics Engineers’ W.R.G. Baker Award, the IEEE Control Systems Society’s George S. Axelby Outstanding Paper Award, and the Distinguished Alumnus and Distinguished Service awards from the Indian Institute of Technology. At the University of Michigan, he was honored with the Arthur F. Thurnau Professorship. He is a fellow of IEEE and the International Federation of Automatic Control.

    Indian-Origin Schoolgirl Raises Funds to distribute Free LED Bulbs to Poor

    NEW DELHI (TIP): Meera Vashisht, an Indian-origin girl living in the US, has raised around Rs. 1.4 lakh through crowd funding to distribute LED bulbs to underprivileged sections in India.

    Meera, who learnt about India’s ‘Unnat Jyoti by Affordable LEDs for all’ (UJALA) program while working on her 7th class science project, collected $2,079.51 with the help of her parents and reached out to 500 people in her vicinity in Houston, Texas, the Power Ministry said.

    She purchased LED bulbs from the Energy Efficiency Services Ltd (EESL), the implementing agency for UJALA, and distributed them to residents of JJ clusters in Keshavpuram in New Delhi today, it added.

    Six hundred families will benefit from 1,800 LED bulbs to be provided under the UJALA scheme from the funds collected by Meera.

    “LED bulbs use less than half the energy of an incandescent bulb and runs for over 7-8 years. I am very happy to have been able to carry out the distribution of LED bulbs and hope to inspire young minds across the globe for working towards energy efficiency,” she said.

    Meera also believes that her effort will result in lighting up 46 houses for one year, reducing electricity bills by Rs. 2,500 and most importantly there will be significant reduction in CO2 emissions every year, the Ministry said.

    Under UJALA, over 12.60 crore LED bulbs have already been distributed across India, which is leading to a daily energy savings of about 4.48 crore kWh and resulting in avoidance of about 3,278 MW of peak demand, it added.

    Through the scheme, the estimated cumulative cost reduction of bills of consumers, per day, is Rs. 17.94 crore and is part of the government’s efforts to spread the message of energy efficiency in the country.

    Project Manager of UJALA scheme in Delhi Jitender Kohli said: “It is inspiring to see the young generation taking lead in conserving the environment.” The UJALA scheme will play a key role in huge energy savings in the state by use of energy efficient LEDs. LEDs, in long term, serve as a cost effective and a safe alternative to the traditional lighting, he added.

    Devyani Khobragade Appointed Private Secretary to Minister Athawale

    NEW DELHI (TIP): Former Deputy Consul-General of India in New York Devyani Khobragade has been appointed as the private secretary to Minister of State for Social Justice and Empowerment Ramdas Athawale.

    A source close to the Republican Party of India chief said an order appointing Devyani was passed July 14.

    Her father Uttam Khobragade, a former IAS officer, is the national executive president of RPI-A, which is part of the Bharatiya Janta Party-Shiv Sena-led Mahayuti (grand alliance) in Maharashtra, and had joined the party in September 2014.

    The 1999-batch IFS officer was arrested on Dec. 12, 2013, in the U.S. when she was India’s deputy consul-general in New York on visa fraud charges and for allegedly providing false declarations in a visa application for her maid.

    She later was released on a $250,000 bond.

    The incident had triggered a diplomatic row between the U.S. and India

She further pointed out that inflation is “quite well-contained”, interest rates are also coming off from their historical highs and “currently they are quite low but may be not low enough to really kick start a lot of investments”. Adding to this she mentioned that the government has given the right kind of impetus with its various flagship programs like Startup India and Digital India.

    Hindus seek New York Mayor’s Apology over School Principal depicted as Goddess

    NEW YORK(TIP): Members of an Indian American Hindu activist group have reached out to New York City Mayor Bill de Blasio and the Department of Education chancellor Carmen Farina for an apology following a New York Daily News report that showed a Queens junior high school principal depicted as a Hindu deity.

    Rajan Zed, a Hindu activist in Nevada, in speaking of a mural that shows Junior High School 226 principal Rushell White as a multi-armed Hindu goddess, said that Hindu goddesses were highly revered in Hinduism and were meant to be worshiped in temples or home shrines and not to be used indecorously or thrown around loosely in reimagined versions for dramatic effects on public school premises.

    He added in the June 29 statement, “Inappropriate usage of Hinduism concepts and symbols for pushing selfish agenda was not okay.”

    Reportedly, the school White leads has a large Hindu population. Assistant principal Dave Possner was reported to have leaked the mural to the press. The situation was compounded further when Possner, 42, of Staten Island, added that White gave him bad marks as payback for exposing the school mural.

    The artwork at the South Ozone Park school also showed Possner as an outcast, tiny little man off in the distance, according to the Daily News report.

    “Mrs. White is after me for being a whistleblower,” Possner told the Daily News. “Anyone can see this is retaliation. She’s angry at me because I exposed her mural in The News.”

    The mural was ordered to be hung up by White, 40, on June 23, but came down June 27 after complaints by staffers at the school.

    Zed, the president of the Universal Society of Hinduism, indicated that the mural was unnecessary and urged the city’s Department of Education to publish a disclaimer about this on its website along with proper explanation about Hindu goddesses.

    “Hinduism is the oldest and third largest religion of the world with about one billion adherents and a rich philosophical thought and it should not be taken frivolously,” Zed stressed. “No faith, larger or smaller, should be ridiculed at.”

    Though seeking the apology from the mayor and education department chancellor, Zed noted that “Hindus understood that the purpose of school mural in this case apparently was not to denigrate Hinduism, but casual flirting like this sometimes resulted in pillaging serious spiritual doctrines and revered symbols and hurting the devotees.”

    Zed further said that Hindus welcomed educational institutions to learn more about Hinduism but take it seriously and respectfully.

    Department of Education officials said they are investigating White’s role in the creation of the mural.

    Truck attacker kills 84 in Nice, France: Drives into Bastille Day crowd, opens fire; shot down by police

    NICE (TIP): France was hit again with a “monstrous” terror attack. Scores of people were killed Thursday, July 14 night when a large truck ploughed through a Bastille Day crowd in Nice, France, in what President Francois Hollande called a terror attack. Incidentally, it is the day of the end of the French Revolution in 1789.

    The death toll grew through the night and at the time of writing this report the number of dead had gone up to 84.

    The driver first shot a gun into the crowd before driving two kilometers along the Promenade des Anglais, the main street in Nice, mowing down people who had gathered to watch fireworks, reports say.

    Police shot and killed the driver, said Pierre-Henry Brandet, a spokesman for the French Interior Ministry. Police found firearms, explosives and grenades in the truck, Estrosi said.

    “We cannot deny that it was a terror attack,” Hollande said in a national television address. He added that the choice of the day — Bastille Day, when France celebrates its post-French Revolution republic — was particularly poignant.

    He said that the day is a “symbol of liberty,” and that “human rights are denied by fanatics and France is quite clearly their target.”

    So far, no group has claimed responsibility. Anti-terror prosecutors have taken over the investigation, according to BFMTV, citing the prosecutor’s office.

    Leaders around the world have condemned the brutal incident.

    U.S. President Barack Obama issued a statement saying, “We stand in solidarity and partnership with France, our oldest ally, as they respond to and recover from this attack.”

    Canadian Prime Minister Justin Trudeau tweeted: “Canadians are shocked by tonight’s attack in Nice. Our sympathy is with the victims, and our solidarity with the French people.” Brazilian President Michel Temer tweeted: “It is regrettable that on the day [that] eternalized fraternity as the motto of the French people, an attack destroyed the lives of so many citizens.”

    The United Nations condemned what it termed a “barbaric and cowardly” terror attack in Nice.

    As Asia woke up to the horrific news, India, China and South Korea’s leaders added their voices to the chorus of condemnation.

    “India shares the pain (and) stands firmly with our French sisters (and) brothers in this hour of immense sadness,” Indian Prime Minister Narendra Modi tweeted.

    In a never-before sharp rebuttal at UN, India says Pakistan “extols virtues of terrorists”

    UNITED NATIONS (TIP): India’s Ambassador to the UN Syed Akbaruddin responded sharply to the remarks made by Pakistan’s envoy Maleeha Lodhi on Kashmir and Wani’s killing during a debate on human rights in the 193-member UN General Assembly here on Wednesday, July 13.

    Strongly hitting back at Pakistan for raising in the United Nations the issue Indian Ambassador has said Pakistan “extols” the “virtues” of terrorists and uses terrorism as a state policy towards the “misguided end” of coveting the territory of others.

    Earlier, in her statement, Pakistan’s envoy Ms. Lodhi, besides raising the Kashmir issue, also mentioned the “extra-judicial” killing of Wani, whom she described as a “Kashmiri leader”, by Indian forces.

    Ms. Lodhi, who has regularly raised the issue of Kashmir at various U.N. fora, termed Wani’s killing as the “most chilling recent example” of “human rights violations” by Indian forces in Kashmir.

    Alleging that the denial of self-determination to Kashmiri people had led to arbitrary detentions, summary executions and other “atrocious” violations, she said, “Its most chilling recent example is the extra-judicial killing last week of a Kashmiri leader, Burhan Wani, shot to death by Indian forces along with dozens of other innocent Kashmiris.”

    In his statement, which sources here termed as perhaps the hardest-hitting against Pakistan in recent times, Mr. Akbaruddin said it is regrettable that Pakistan attempted to “misuse” the U.N. platform.

    “Regrettably, earlier today we have seen an attempt at misuse of this U.N. platform. The attempt came from Pakistan; a country that covets the territory of others; a country that uses terrorism as state policy towards that misguided end; a country that extols the virtues of terrorists and that provides sanctuary to U.N.-designated terrorists; and a country that masquerades its efforts as support for human rights and self-determination,” he said.

    “The international community has long seen through such designs. Cynical attempts, like the one this morning therefore, find no resonance in this forum or elsewhere in the United Nations,” he noted.

    Ambassador Akbaruddin asserted that Pakistan’s “track record” failed to convince the international community that it should gain membership of the Human Rights Council in this very session of the UNGA.

    “We remain strongly committed to the promotion and protection of all human rights for all through pursuit of dialogue and cooperation,” he added.

    Over 30 people have been killed and more than 250 injured in clashes between protesters and security personnel after Wani’s killing last week.

    The U.N. has expressed concern over the tensed situation in Kashmir, with U.N. Secretary General Ban Ki-moon calling on all parties to exercise “maximum restraint to avoid further violence and hopes that all concerns would be addressed through peaceful means.”

    Blessed Mother Teresa of Kolkata to be Canonized on Sept. 4, 2016

    NEW YORK (TIP): Mother Teresa was widely known as a living saint as she ministered to the sick and the dying in some of the poorest neighborhoods in the world. Although some people criticized her for not also challenging the injustices that kept so many people so poor and abandoned, her simple service touched the hearts of millions of people of all faiths.

    Born to an ethnic Albanian family in Skopje, in what is now part of Macedonia, she went to India in 1929 as a Sister of Loreto and became an Indian citizen in 1947. She founded the Missionaries of Charity in 1950.

    Shortly after she died in 1997, St. John Paul II waived the usual five-year waiting period and allowed the opening of the process to declare her sainthood. She was beatified in 2003.

    After her beatification, Missionary of Charity Father Brian Kolodiejchuk, the postulator of her sainthood cause, published a book of her letters, “Mother Teresa: Come Be My Light.” The letters illustrated how, for decades, she experienced what is described as a “dark night of the soul” in Christian spirituality; she felt that God had abandoned her. While the letters shocked some people, others saw them as proof of her steadfast faith in God, which was not based on feelings or signs that he was with her.

    The date chosen for her canonization is the eve of the 19th anniversary of her death and the date previously established at the Vatican for the conclusion of the Year of Mercy pilgrimage of people like her who are engaged in works of mercy.

    LONDON (TIP): In her first public remarks, June 13, the new British Prime Minister Theresa May struck a populist tone, saying she planned to continue predecessor David Cameron’s “true legacy” of social justice.

    The Conservative Party leader spoke directly to the poor, black and white working-class residents as well as women, youth and those with mental health issues, saying, “The government I lead will be driven not by the interests of a privileged few, but by yours.”

    Her party prizes unionism, she said, and not just among England, Wales, Scotland and Northern Ireland, “but between all of our citizens, everyone, whoever we are and wherever we’re from.”

    Cameron has led a one-nation government, and it is in that spirit that I also plan to lead,” she said.

    Before resigning, Cameron delivered remarks outside 10 Downing Street, saying, “It’s not been an easy journey, and of course we’ve not got every decision right, but I do believe that today our country is much stronger.”

    He wished May the best, especially as she negotiates the country’s “Brexit” from the European Union. If he were granted one wish, he said, it would be the “continued success of this great country that I love so very much.” Cameron will continue on as a member of Parliament.

    Earlier Wednesday, Cameron appeared to be in a jovial mood as he told members of Parliament: “I have addressed 5,500 questions from this dispatch box — I’ll leave it to others to decide how many I’ve answered.”

    He held up a photo of himself with Larry the Downing Street cat, saying he loved the “chief mouser” and was sad to be leaving him behind.

    On a more serious note, Cameron said he cared passionately about the UK, adding that “we need to make sure as we leave the EU, how we keep the benefits of the common travel area.”

    Gesturing across the room and up to his wife, Samantha, watching from the gallery, he said: “I will miss the roar of the crowd, I will miss the barbs from the opposition, but I will be willing you on.

    “Nothing is really impossible if you put your mind to it. After all, as I once said, I was the future once.”

    NEW DELHI (TIP): India shares France’s pain, Prime Minister Narendra Modi said Thursday morning, strongly condemning the horrific terror attack in Nice that has killed 84 people and left scores injured, several critically.

    “Appalled by the horrific attack in Nice. I strongly condemn such mindless acts of violence. My thoughts are with the families of deceased. I hope the injured recover soon. India shares the pain & stands firmly with our French sisters & brothers in this hour of immense sadness,” (sic) PM Modi tweeted.

    The government has said that so far there are no reports of any Indians being among the dead or wounded in Nice, where a large truck ploughed through hundreds of spectators gathered to watch Bastille Day fireworks at the famous Promenade des Anglais.

    The Indian embassy in French capital Paris has set up a helpline in Nice: +33-8-20-26-06-06 and Indian Embassy’s Paris helpline: +33-1-40507070.

    French President Francois Hollande has called the Nice attack “undeniably an act of terror,” and has extended a state of emergency in France by three months.

    I returned from a very successful Africa visit, where I got to interact with political and business leaders across four nations. My visit began in Mozambique and ended in Kenya. The other two nations visited were Tanzania and South Africa.

    Naturally, the economic agenda of the visit was high on the priority of my delegation and I. In all the four nations I went, ways to deepen our economic cooperation and improve trade ties were comprehensively discussed.

    With Mozambique, I see a great scope for wide ranging economic cooperation. Mozambique’s strengths are also the areas of India’s need. And, what Mozambique requires, is available in India. We want to fast track cooperation in the field of agriculture and food security. There is a rich potential to deepen cooperation in skill development and healthcare as well.

    In South Africa, President Zuma and I addressed a business forum, where both Indian and South African CEOs were present. India and South Africa enjoy historical people-to-people and economic ties. 

    You would be delighted to know that India-South Africa bilateral trade has grown by 380% over the last few years. There is continuous flow of investments both ways. Many Indian companies are active in South Africa and vice versa.

    However, we do not want to stop here. The scope of bettering this cooperation is increasing by the day. And, India and South Africa are uniquely positioned to complement each other.

    I see India and South Africa working together in areas like defence, dairy, IT, skill development to name a few.

    The third nation I visited, Tanzania, has a healthy economic relationship with India and this relationship is growing. Our annual trade is on the rise and so are Indian investments. I told President Magufuli that India will be a trusted partner in Tanzania’s development priorities. With Tanzania, the scope of cooperation in the fields of agriculture, energy, natural gas, economic capacity building is immense. India is also ready to meet the healthcare priorities of the Tanzanian government, including supply of medicines and equipment.

    My visit to Kenya was memorable because of the wide range of programme and the comprehensive level of discussions with President Kenyatta, particularly on trade and the economy. President Kenyatta and I addressed a business summit and even met Kenyan as well as Indian innovators before the summit.

    It is a fact that the India-Kenya friendship is a win-win situation for both our nations. Together, this partnership can be beneficial for India, Kenya and the rest of the world. 

    Here are some of the avenues of cooperation that I highlighted:

    I also extended India’s deepest appreciation and total support for the ‘Make it Kenya’ initiative of the Kenyan government. This is a wonderful effort to raise the economic potential of Kenya and provide opportunities for the Kenyan youth.

    In conclusion, I wish to state that together, India and Africa constitute a third of humanity. Africa is at the core of our foreign policy. Last year, I had the honour of welcoming African heads of state for the India-Africa Summit. This was the start of new era in India-Africa ties and will lead to empowerment of the youth both in India and across Africa.

Rohit Kumar Singh, Joint Secretary, Ministry of Road Transport and Highways, highlighted specific investment opportunities in the highways sector; whereas Alok Srivastava, Additional Secretary, Ministry of Shipping, shared details on the Sagarmala Program – the Ministry’s flagship port-led development initiative to bring down logistics cost and boost investment, exports, and jobs.

    USIBC President Dr. Mukesh Aghi said, “With an upsurge in India’s e-commerce markets and the unprecedented growth in Indian cities, there is a critical need for advanced logistical services and better transportation infrastructure. India needs $1 trillion for developing new roads, ports, rail lines, and airports over the next few years and U.S. companies can provide the necessary expertise as well as capital to enable the robust growth of this sector. We are excited to witness the rapid growth of this sector— under Minister Gadkari’s leadership, road construction rates have gone up, infrastructure spending has received a boost and India has jumped ranks in the Logisitics Performance Index.     Dr. Ravindra Verma, Managing Director of TransAsia Infrastructure Group, a confederation that manages and executes multi-modal integrated transport and logistics infrastructure in Asia provided an industry perspective during the discussion. More than $100 billion in capital is now needed over the next several years to expand existing corridors and build new ones to keep up with the growth in traffic. This presents an opportunity for all players in North America to mobilize resources on a major scale. We are now actively gathering over $1 billion in global capital towards a dedicated multi-modal surface transport platform RoadStar, with major focus on India.”

    Wing Commander Pooja Thakur Drags IAF To Court after being denied permanent commission

    New Delhi, July 14 – Wing Commander Pooja Thakur, who led the Guard of Honour during US President Barack Obama’s visit here last year, has moved the Armed Forces Tribunal here after being denied a permanent commission by IAF.

    A Permanent commission would allow one to retire at 60 years of age with full benefits and would also enable them to be promoted to Lieutenant General.

    In her petition, the officer has claimed that IAF’s decision to deny her permanent commission is “biased, discriminatory, arbitrary and unreasonable”.

    The tribunal has admitted the matter and has sought IAF’s response within four weeks, Thakur’s lawyer Sudhanshu Pandey said.

    “IAF says Pooja Thakur was offered permanent commission in 2012, she declined it then and it can be offered only once. No new offer can be given,” said her lawyer.

    “She had said no only because she was temporarily not willing at the time,” he added.

    Thakur led an Inter-Service Guard of Honour last year when President Obama visited India in January.

    Obama had said later said the sight of “incredible” Indian women in the armed forces was one of his “favourite things” in India.

    Thakur had then said, “It feels good that we have been able to achieve our aim of giving him a befitting Guard of Honour. I am glad that he has appreciated.”

    The defence forces, in a first, had chosen women officers to lead their marching contingents during the Republic Day parade last year.

    Thakur, who joined IAF in 2000, belongs to the administrative branch and is currently posted at ‘Disha’, the publicity cell under the Directorate of Personnel Officers at the Air Force Headquarters.

    As part of her duty, she was involved with the initiation and development of the IAF mobile game “Guardians of the Sky” which was visualised as a new and innovative step to reach the mobile-friendly tech-savvy students.

    Twitter Blocks ‘HafizSaeedLive’ Account

    Twitter on Thursday, July 14, has blocked the account of Jamaat-ud-Dawa (JuD) chief and 2008 Mumbai terror attacks mastermind Hafiz Saeed.

    The micro-blogging site apparently on its own took the action against the JuD chief.

    The Twitter handle ‘HafizSaeedLive’ had frequent updates from the JuD chief.

    The Twitter account had Saeed’s picture and claims to be a philanthropic organization also tweeted in Hindi on the JNU backlash back in February.

    However, there is another Twitter account @HSaeedOfficial which has a similar picture and claims to be the same organization.

    The United Nations declared JuD a terrorist organization in December 2008 as also Saeed who was also individually designated by the United Nations under UNSCR 1267 in December 2008.

    Pakistan has said that there is no case against Saeed and that he is free to move in the country as a Pakistani national.

    India has repeatedly demanded Pakistan to hand over Saeed for questioning over his role in the 2008 Mumbai attacks that claimed 166 lives.

    JuD was banned in 2002 by Pakistan but later a court lifted the ban due to lack of evidence on the group’s involvement in militancy.

    The group is banned by the US, the EU, India and Russia as a terror organisation.

    In June 2014, the US declared JuD a subsidiary of terror group Lashkar-e-Toiba.

    South China Sea Verdict – China loses its case in Permanent Court of Arbitration @Hague

    Judges at an arbitration tribunal in The Hague on Tuesday, July 12, rejected China’s claims to economic rights across large swathes of the South China Sea in a ruling that will be claimed as a victory by the Philippines.

    The Dispute – Approximately 3.5 million square km area of the South China Sea has been under dispute as China, the Philippines, Vietnam, Malaysia, Taiwan and Brunei have all claimed sovereignty over this territory. This area of the sea is rich in oil and gas fields.

    In a major diplomatic blow to China, the Permanent Court of Arbitration struck down the Communist giant’s claims in the strategic South China Sea yesterday.

    The Hague-based court has said that China violated the Philippines’ sovereign rights. It said China has caused “severe harm to the coral reef environment” by building artificial islands.

    China has backed its territorial claim by building on these islands and running naval patrols near them. While the US says it is not taking any side in the argument, it has sent military ships and planes to the area, which has irked China.

    Both China and the US have accused each other of “militarising” the South China Sea.

    China claims the waters saying the area is within its “nine-dash line”, which extends hundreds of miles to the south and east of its island province of Hainan. Nine-dash lines are the dashes that demarcate virtually all of the South China Sea as Chinese territory, under the United Nation Convention on the Law of the Seas, or UNCLOS.

    China has been taking what analysts say are “passive-aggressive” steps, which is to use fishing vessels and oil rigs to change the status quo on the ground and assert sovereignty over the area.

    China has reiterated time and again that it has had rights to the territories for centuries, a claim that is contested by Vietnam and Taiwan.

    China wants to negotiate directly with the Philippines and each of the four other claimants in an arrangement that would give it leverage for its sheer size and influence. Beijing has steadfastly opposed bringing the disputes to an international arena, which could provide the US a chance to intervene.

    The Philippines asked a tribunal of five arbitrators to declare as invalid China’s vast claims using the “nine-dash line”. However, China and the Philippines are among more than 160 signatories of the 1982 convention, regarded as the constitution that governs and stipulates the rights of countries in using the world’s oceans.

    Still, the Philippines asked the tribunal to classify whether a number of disputed areas could be called islands, low-tide coral outcrops or submerged banks. That’s so it can be determined whether China is indeed entitled to the stretch of territorial waters under the convention. It also wants China to be declared in violation of the convention for carrying out fishing and construction activities that breached the Philippines’ maritime rights. The convention does not deal with sovereignty questions, which the Philippine government says it did not raise.With China’s claims, the Philippines stands to lose a huge chunk of off-shore territory, said Antonio Carpio, an associate Supreme Court justice who has made extensive studies on the conflicts, to Reuters. “This Chinese aggression is the gravest external threat to the Philippines since World War II,” he said.

    United States’s View – The US has urged countries in the Asia-Pacific region not to engage in “escalatory or provocative” actions in the South China Sea following a decisive ruling by an international tribunal over the disputed region.

    “We certainly would encourage all parties to acknowledge the final and binding nature of this tribunal. We certainly would urge all parties not to use this as an opportunity to engage in escalatory or provocative actions,” White House Press Secretary Josh Earnest told reporters yesterday while travelling with US President Barack Obama to Dallas.

    Earnest said the US was not a claimant to any land features in the South China Sea. “Our interest lies in a desire for a peaceful resolution to disputes and competing claims in that region,” he said.

    Earnest said the US wanted to preserve the freedom of navigation and free flow of commerce in that region of the world.

    Noting that the South China Sea is a strategically important region of the world, he said, it is also is a route for billions of dollars in commerce.

    “It is important to the US economy that that flow of commerce not be significantly disrupted. That’s why we have gone to great lengths to make clear that we’re not a claimant, Earnest said.

    State Department Spokesman John Kirby said if China failed to abide by the ruling, it would be in breach of international law.

    “The world is watching now to see what these claimants will do. The world is watching to see if China is really the global power it professes itself to be and the responsible power that it professes itself to be. The world’s watching this,” Kirby said.

    India’s stand

    India’s discomfort has increased sharply because New Delhi finds that what China is doing in the South China Sea is being replicated in spirit and tactics on the China-Pakistan Economic Corridor (CPEC), which goes through territory claimed by India. While India does not want to escalate tensions by challenging China on the South China Sea, it worries whether anybody will support India’s stand on CPEC.

    China has declared via its state media outlets that India is sympathetic to China’s view, and its joint statement with India and Russia affirms it. Meanwhile, US Pacific Command chief, Admiral Harris indicated India and US may soon be sailing together for joint patrols, as part of a roadmap of the Strategic Vision document signed when Barack Obama visited India in 2015.

    In recent days, reports said India and US were discussing working together to track submarines and on anti-submarine warfare, a move clearly aimed at China.

    World’s View – Most countries have generally taken a position on the arbitration case depending on whether they’re aligned with the US or China.

    The diplomatic tug-of-war has put smaller countries and regional blocs in a dilemma, including the Association of Southeast Asian Nations, whose four member states are claimants.

    A Philippine push for the 10-nation bloc to issue a joint statement calling for China to respect Tuesday’s ruling has stalled with Cambodia and Laos backing the Chinese position. Besides the Philippines and Vietnam, Malaysia, Indonesia and Singapore have also been wary of China.

    The regional group has a bedrock principle of deciding by consensus, meaning just one member state can stall any group effort.

    The US, Britain and the rest of the EU support the arbitration.

    China claims support of some 40-60 nations, including many landlocked African nations and Pacific islands where Beijing has economic clout.

    Bernie Sanders, whose calls for a “political revolution” energized millions of voters across the nation, offered a long-awaited endorsement of his Democratic rival Hillary Clinton today, calling for unity just two weeks shy of the Democratic National Convention.

    Standing alongside one another at an event in Portsmouth, N.H., Sanders, a self-described democratic socialist, congratulated Clinton for winning the nomination and vowed to do everything he can to help her beat presumptive Republican nominee Donald Trump.

    “Hillary Clinton understands that we must fix an economy in America that is rigged and that sends almost all new wealth and income to the top one percent,” Sanders said, listing his reasons for endorsing her.

    “Hillary Clinton understands that if someone in America orks 40 hours a week, that person should not be living in poverty.”

    Democrats have coalesced around Clinton’s candidacy since she defeated Sanders in primaries last month in California and five other states, led by endorsements from President Barack Obama, Vice President Joe Biden and others.

    Sanders has spent the past month seeking to influence the party’s platform at the Philadelphia convention and promote electoral reforms including allowing independents to participate in future primaries.

    The platform includes many of his proposals, including a USD 15 an hour minimum wage, tougher restrictions on Wall Street and an end to the death penalty.

    The event at a Portsmouth high school sought to project Democratic unity before Republicans formally nominate Trump next week in Cleveland but some Sanders’ supporters in the crowd did not appear to be ready to move on.

    Chants of “Bernie” broke out in the gymnasium while opening speakers addressed the crowd, prompting Clinton’s faithful to chant, “Unity.” When Sen. Jeanne Shaheen, a Clinton supporter, told the audience, “We need to elect Hillary,” some Bernie supporters stood and shouted, “No,” which was followed by chants of “Hillary” in the crowd.

    “It’s like he’s giving up if he endorses her,” said Steve Rand, a hardware store owner from Plymouth, New Hampshire, before the two candidates took the stage. “She stands for everything that I am against,” he added.

    Bill Introduced to Block Indian Firms from Hiring H-1B, L-1 Visa Workers

    WASHINGTON — A bipartisan group of two U.S. lawmakers has introduced in the House of Representatives a legislation, which if passed by Congress would prevent Indian companies from hiring IT professionals on H-1B and L-1 work visas.

    Since the revenue model of the majority of big Indian and U.S. IT companies is heavily dependent on H-1B and L-1 visas in the U.S., such a bill is likely to have a major impact, if not sound a death knell, on their business.

    The “H-1B and L-1 Visa Reform Act of 2016” introduced by Reps. Bill Pascrell, D-N.J., and Dana Rohrabacher, R-Calif., would prohibit companies from hiring H-1B employees if they employ more than 50 people and more than 50 percent of their employees are H-1B and L-1 visa holders.

    Before the bill is signed into a law by President Barack Obama, it needs to be passed by the Senate, wherein it has not been tabled so far. Notably, the two sponsors of the bill come from the two American states that have the maximum concentration of Indian Americans.

    “America is producing many skilled, high-tech professionals with advanced degrees and no jobs. By ‘in-sourcing’ and exploiting foreign workers, some businesses are abusing the visa programs and undercutting our workforce to reap the rewards,” Pascrell said. “Without the critical reforms our bill proposes, American workers will continue to be unfairly displaced and visa workers will continue to be mistreated — both of which are unacceptable.”

    Noting the foreign outsourcing companies are the top users of the H-1B and L-1 visa programs, a media statement issued by the congressman’s office said over the years a number of concerns have been raised about how certain companies have been using these visa programs, including a 2011 report from the Government Accountability Office calling for reform.

    Pascrell and Rohrabacher had introduced a similar version of this bill in 2010, which could not gain enough support in Congress.

    The lawmakers said the H-1B and L-1 Visa Reform Act of 2016 would close loopholes in the H-1B and L-1 visa programs, reduce fraud and abuse, provide protections for American workers and visa holders, require more transparency in the recruitment of foreign workers and increase penalties on those who violate the law.

    That would require employers to make a good faith effort to recruit and hire American workers before bringing in visa workers, and prohibit employers from replacing American workers or giving preference to visa holders when they are filling open positions, they said.

    It would provide more authority to the departments of Homeland Security and Labor to investigate fraud and abuse in the H-1B and L-1 programs.

    Modifying existing H-1B wage requirements and established wage requirements for L-1 workers, the bill would provide visa holders with a list of rights before they enter the U.S. so that they are better protected against mistreatment or underpayment of wages.

    The American Federation of Labor and Congress of Industrial Organizations and the Institute of Electrical and Electronics Engineers have endorsed the bill.

    “We applaud (the) long-term commitment to addressing the glaring gaps in protections in our current skilled visa programs,” AFL-CIO government affairs department director William Samuel wrote in support of the bill. “These loopholes have resulted in the mistreatment of H-1B workers and U.S. workers alike, and have led to the egregious displacement scandals that continue to make headlines and discredit these programs.”

    Added IEEE president Peter Eckstein, “It is more than clear that the H-1B and L-1 visa programs are being used by major companies across our economy to hire cheap, disposable workers in place of their American employees. Reports of Americans being fired and replaced by non-Americans, who will never be invited to become Americans, can no longer be dismissed as mere ‘anecdotes.’ Rather, outsourcing companies dominate the H-1B and L-1 programs, annually costing America tens of thousands of good, middle-class jobs,” he added.

    PM Modi Reviews Kashmir Situation, Appeals for Peace

    Prime Minister Narendra Modi, July 12, held a high-level meeting over the violence in Jammu and Kashmir, which has claimed 33 lives, and appealed for calm even as curfew continued for the fourth consecutive day in the Valley.

    Modi, who returned to the capital early in the morning after his four-nation tour of Africa, held the review meeting that was attended by Home Minister Rajnath Singh, External Affairs Minister Sushma Swaraj, Finance Minister Arun Jaitley, Defence Minister Manohar Parrikar, National Security Advisor Ajit Doval, and Foreign Secretary S. Jaishankar besides senior security officers.

    The meeting took stock of the situation in the Kashmir valley that has seen repeated clashes between thousands of protesters and security forces following the killing of Hizbul Mujahiddin commander Burhan Wani July 8.

    Besides 33 people killed in the violence so far, nearly 1,400 people have been wounded, many seriously.

    The Prime Minister also voiced concern over the violence in the Valley where curfew continued for the fourth consecutive day July 12.

    ” The Prime Minister has appealed to the people of Jammu and Kashmir to maintain calm and peace so that normalcy returns in the valley and no innocent lives are lost,” Minister of State in Prime Minister’s Office Jitendra Singh told reporters soon after the meeting concluded.

    Jitendra Singh also said that the Prime Minister offered every assistance to the state government and assured it of providing every help.

    He said the Prime Minister is keeping a close watch on the sequence of events in the valley.

    The Prime Minister also expressed hope that innocent people should not face inconvenience and expressed satisfaction over the ongoing Amarnath Yatra.

    In Kashmir, amid curfew in most parts of the valley, the authorities grappled to control continuing violence.

    Police said “strict curfew shall continue” almost all across the valley to prevent the spillover of street violence and counter-violence.

    Separatist groups have extended the ongoing protest shutdown in the valley until July 13.

    National Conference leader and former Chief Minister Omar Abdullah raised questions on Jammu and Kashmir being “unrepresented” at the high-level meeting.

    In a tweet, Abdullah said that Chief Minister Mehbooba Mufti’s presence at the meeting could have been ensured via video-conferencing.

    “I understand if Mehbooba Mufti didn’t leave the state to attend (the meeting) but why not by video conference? State unrepresented,” Abdullah tweeted.

    Reacting to the prevailing situation in the valley, Congress Vice president Rahul Gandhi said that the gains made during the UPA regime in Jammu and Kashmir have been nullified by the “fatalistic policies” of the Modi government.

    Speaking at an Eid Milan reception hosted by Jamiat Ulema-e-Hind chief Maulana Asad Madni here on July 11 night, Gandhi said that mishandling the situation in the Kashmir Valley had led to political turmoil.

    MIM chief Asaduddin Owaisi urged the Centre to call an all-party meeting on the violence in the Kashmir Valley.

    The Hyderabad MP said the meeting should be called to discuss how to end the cycle of violence and to show empathy following street protests that have claimed 32 lives.

    A group of Muslim clerics met with Home Minister Rajnath Singh to discuss ways and means to restore normalcy in the Kashmir Valley.

    The clerics said the Minister assured them of all possible help in restoring peace in the disturbed valley.

    Umer Ahmed Ilyasi of All India Organization of Imams of Mosques told media later that they will visit Kashmir and urge people, especially religious leaders, there to help the valley to return to normalcy.

    Ilyasi said he along with other Muslim religious leaders will also meet Chief Minister Mehbooba Mufti.

    Meanwhile, the annual Amaranth Hindu pilgrimage resumed July 11, as 300 vehicles carrying pilgrims from different states of India entered the Kashmir Valley.

    New Delhi (TIP): Delhi High Court on Wednesday, July 13, asked Arvind Kejriwal to explain the meaning of the word ‘thulla’ he allegedly used against policemen, as it stayed a trial court order summoning the Delhi Chief Minister in a criminal defamation complaint filed against him by a constable.

    Justice Mukta Gupta granted the relief to Kejriwal till August 21 on his plea seeking stay on the summon issued to him by a trial court for his appearance on July 14, which prima facie found that he had committed the offence.

    “Till the next date (August 21) the petitioner (Kejriwal) is exempted from personal appearance before the trial court,” the court said.

    However, “you (Kejriwal) will have to satisfy this court what is the meaning of the word that was allegedly used by you. So be ready,” the court said.

    The word used by Kejriwal was a Hindi word and the court wanted to know its meaning as it does not exist in the dictionary. “If you have used this word, you must be knowing the meaning. I have not seen this word at all,” the judge orally observed.

    The court also issued notice to the complainant, Constable Ajay Kumar Taneja, and sought his response on the Delhi Chief Minister’s plea.

    The court’s order and oral observation came during the hearing of the plea by Kejriwal who sought stay and setting aside of the trial court’s order summoning him as an accused in the case.

    Senior advocate N Hariharan, appearing for the Chief Minister, submitted that the word ‘thulla’ was not used against all policemen but against those indulging in wrong practices.

    Constable Taneja, posted at Lajpat Nagar police station here, had claimed that being a member of Delhi Police he was defamed by the word used by Kejriwal.

    In the complaint, filed on July 23, 2015, Taneja had claimed that Kejriwal had used the “derogatory” term for policemen on a news channel while talking about AAP government’s “constraints” in ensuring effective functioning of the Anti-Corruption Branch.

    MUMBAI — He is a voracious reader of fiction and non-fiction books. Bollywood superstar Shah Rukh Khan revealed his favorite books while interacting with his fans via #fame, a live video social platform.

    Among his favorite books are E.L. James’ “Fifty Shades of Grey” and Walter Isaacson’s “Steve Jobs.”

    It was during his shoot for Yash Chopra’s “Jab Tak Hai Jaan” in London that Khan got several copies of “Fifty Shades of Grey.”

    While he tried reading the book in London, he has yet to finish it.

    Despite not reading it cover to cover, Khan praised the book, saying: “Many may think that the movie is not great, but I enjoyed it. It is quite interestingly put together.”

    Khan says the biography of former Apple CEO, the late Steve Jobs, changed the way he looks at business platforms and showed him new avenues that he could tap into.

    He said: “At Red Chillies Entertainment (his motion picture production and distribution company), I was involved in multiple businesses. But after reading the book, I realized that focusing only on one thing will help.

    “So, we stopped TV and ad production and focused entirely on films and visual effects. There is a lot of stuff in the book that I don’t agree with, but who am I to disagree with Steve Jobs?”

    Another book that the “Dilwale” star lists as a favorite is Malcolm Gladwell’s “Blink,” which explains that in a competition, the guy who blinks first loses first.

    He recommended Blake Snyder’s “Save the Cat!” for all aspiring writers.

    “This is one of the best books on screenplay writing that I have read so far,” he said.

    Indian-American Prof Dr Kinshuk Named As Dean Of University Of North Texas College

    Dr Kinshuk, who goes by single name, has been named the dean of University of North Texas College of Information in the US.

    He received his doctoral degree from De Montfort University in England, a master of science in mechanical computer aided engineering from Strathclyde University in Scotland and a bachelor’s degree in mechanical engineering from University of Rajasthan in India.

    Prior to joining UNT, Kinshuk was the associate dean of the faculty of science of technology at Alberta, Canada-based Athabasca University, where he had been since 2010.

    In that role, he helped start new graduate programmes, gained external research funding, developed strategies for student recruitment and promoted senior students and alumni to serve as mentors for new students.

    Prior to this, he served as director in the School of Computing and Information Systems.

    Kinshuk also served as Industrial Research Chair in Adaptivity and Personalisation in Informatics for the National Science and Engineering Council of Canada.

    “Dr Kinshuk brings with him great leadership and research experience,” Finley Graves, provost and vice president for academic affairs at UNT, said in a statement.

    “We look forward to Dr Kinshuk working with our faculty to articulate a clear vision for the future of the College of Information.”

    Kinshuk will start his new position from August 15.

    “I’m really looking forward to joining such a progressive university and my esteemed new colleagues,” Kinshuk, who also served as the president and chief executive officer of Smart Informatics Ltd., said in a statement. “I know the College of Information has high expectations and I hope to meet them and raise those even more. I am keen to contribute to the college’s success and help make the University of North Texas even more prestigious.”

    Kinshuk’s career also includes a variety of other academic positions.

    At Massey University in New Zealand, Kinshuk was the director of the Advanced Learning Technologies Research Center, as well as an associate professor, and before that, a senior lecturer.

    He also was a research fellow for the German National Research Centre for Information Technology in St. Augustin, Germany.

    Earlier in his career he was an instructor at the Academy of Computer Education in India, as well as a part-time lecturer at the Government Polytechnic College in India.
