    Modi challenges ‘scared’ Rahul to come and campaign in Gujarat

    VALSAD (TIP): Amid growing speculation of a Narendra Modi versus Rahul Gandhi electoral battle in 2014, the Gujarat chief minister indirectly challenged Rahul to come and campaign in the state. “Now Congress says Rahul is not coming to Gujarat. Why? People of the state and I want to know the reason. Does he think Gujarat is so bad that he won’t tour the state?

    ” Modi said, addressing a rally in Mota Pondha village in Valsad district of south Gujarat. Modi’s jibe comes at a time when the Congress does not want to take any chances to pit the 42-year-old party general secretary against the BJP strongman on his own turf, lest he suffer the ignominy similar to the Uttar Pradesh debacle and further dent is already waning. Modi addressed a series of rallies in south Gujarat as a part of his monthlong Swami Vivekanand Yuva Vikas Yatra.

    In Pardi town near Vapi, BJP leader Smriti Irani also took potshots at Rahul saying, “How can he come to Gujarat when he has completely lost face after Congress’s drubbing in Uttar Pradesh elections?” Addressing a rally in Valsad, Modi threw an open challenge to UPA chairperson Sonia Gandhi, Prime Minister Manmohan Singh and Rahul Gandhi. “I am ready for any contest,” he said.

    Modi was also severe in his criticism of Congress’s slogan ‘Change the direction to change your condition’ saying that the party’s only direction was “dynasty rule”. “Only one family gets importance…. If they make someone Prime Minister, he has to go to the family before taking any decision,” he said. “Congress’s ‘direction’ is of nepotism, spreading communalism, divisive politics and not fulfilling promises,” he alleged.

    SRINAGAR/JAMMU (TIP): Intelligence sources called the arrest of Mehrajuddin Wani alias Javed Dand —one of the terrorists who arranged logistics for the Kandahar hijackers—a big catch, and the terror suspect appeared to conform to that billing when he, according to the J&K police, disclosed that the diplomat of an unspecified embassy (in Nepal) was closely involved in the 1999 hijacking plot.

    “We are investigating all this,” said Dilbagh Singh, IGP of Jammu. Intelligence sources in Delhi said that he could shed new light on hijackers, who had killed one young Indian traveler, Rupen Katyal, and how they managed to pull off the audacious hijacking. The hijacking, in which the then Taliban regime had colluded, resulted in the release of three terrorists, including Maulana Masood Azhar, Mustaq Ahmed Zargar and Omar Saeed Sheikh, in exchange of hostages of the ill-fated aircraft.

    Azhar had set up one of deadliest terror outfits Jaish-e- Mohammed (JeM), while Sheikh ended up kidnapping and murdering the Wall Street Journal journalist Daniel Pearl in Pakistan in 2002. The hijacking, which dealt a heavy blow to BJP’s “tough-on-terror” credentials, embittered the already strained ties with Pakistan that allowed Azhar and Sheikh to roam in full public view and carry on with their anti-India activities.

    The IGP said that police, acting on specific intelligence inputs, launched a search operation and arrested Mehrajuddin – a close associate of United Jihad Council chief Syed Salahuddin as well as underworld don Dawood Ibrahim – on Jammu-Srinagar highway while he was travelling from Nepal to Kashmir on Wednesday night. “We suspect that his services have been used (in the hijacking).

    He was there (in Nepal) when the aircraft was hijacked in 1999,” Singh said. Mehrajuddin, undergoing treatment for brain tumour in Nepal, was on his way to Sopore to meet his family members and relatives. Police suspect that Mehrajuddin — once an ordinary tailor at Nigeen Bagh in Sopore — has strong links with Pakistan’s ISI, and is also believed to be engaged in raising funds for terror activities. He is also suspected to be involved in smuggling weapons, ammunition and fake currency into India with the help of the diplomat

    KOLKATA (TIP): Indicating that he is keeping all his options open for the 2014 Lok Sabha elections, Samajwadi Party chief Mulayam Singh Yadav on Thursday announced that his party would go to polls alone and would play a key role in formation of the next government at the Centre. He said the two national parties, Congress and BJP, were fast losing ground and that a non-BJP, non-Congress third front would take shape after the elections.

    “The third front has always taken shape after elections,” Mulayam said while citing past examples. When asked if he was eyeing the Prime Minister’s post, the SP chief said he had no ambition for the top job. “Such questions usually come from those who don’t want to see a third front coming up,” he said with a laugh.

    “As of now, we have decided to go to polls alone. We have had no talks with any political party for a prepoll alliance,” he added. Talking to reporters after the party’s national executive in Kolkota, Mulayam blamed the Congress government’s “misrule” for price hike and corruption but at the same time said the SP would not field any candidate against Congress president Sonia Gandhi in Rae Bareli in the Lok Sabha elections as a “thanksgiving gesture” in return for the Congress not putting up any candidate against his daughter-in-law Dimple in Kannauj by-polls.

    Unlike other SP leaders, Mulayam refrained from commenting on whether Rahul Gandhi was PM material. “I offer my best wishes to Rahul on whatever he does in politics,” he said. However, he skirted queries on whether the SP would give a walkover to Rahul in the LS polls. When asked about Congress’s allegation that he was unreliable, a visibly agitated Mulayam said, “I am known for keeping my word.”

    NEW DELHI (TIP): State-run Coal India Limited’s pleas for coal blocks may have fallen on deaf ears but the government did not hesitate in asking the Maharatna company to go as far overseas as Mozambique in south-east Africa to prospect for coal.

    For over four years, Coal India repeatedly wrote to the coal ministry seeking allocation of 130-odd blocks the public sector company said were essential for its expansion and for meeting existing commitments.

    The ministry woke up to Coal India’s entreaties only after Coalgate and files began to move. But prior to Coalgate singeing the government, the coal ministry was more keen on backing propositions in a corner of Africa than domestic options.

    In May, Coal India informed BJP MP Hansraj Ahir – whose complaint set off the CBI probe into allocations of coal blocks to private operators – that four CIL officers were posted in Mozambique to pursue opening of mines in that country.

    Coal India officers were deputed to Coal India Africana Limitada, CIL’s subsidiary set up to explore and source coal in Mozambique. The venture set up shop in the city of Tete in March and expressions of interest for drilling – duly reported in the media – were invited in May.

    Around the same time, Coal India was having a hard time persuading the coal ministry to consider the allocation of 138 blocks with reserves of 57 billion tonnes to “sustain long-term production programme of CIL to meet the country’s demand”.

    The government argued that CIL was unable to meet requirements of Indian companies, both private sector and state-run, and this had necessitated allocating blocks to private companies. But while CIL plans took a hit, private players failed to meet commitments defeating the government’s “power for all” policy.

    The PSU received no intimation with regard to its requests till very recently. Coal India has been writing to the ministry since at least August 2008 about the blocks to little avail. On the other hand, the government set aside blocks for private parties who now face threat of action for not meeting timeframes.

    Tete, a city located in the interior of Mozambique on Zambezi river, is the base of Coal India operations in the African country. A consultant has been appointed for undertaking an environmental impact assessment and preparing an environmental management plan so that drilling can start in a few weeks, CIL said.

    CIL informed that a memorandum of understanding has also been finalized for an apex training organization for local people and the planning and designing of an institute is in progress.

    The PSU’s enterprise in seeking to access coal deposits in a far flung country might be justified as mirroring similar ventures undertaken by Chinese companies in Africa, but CIL being denied access to coal blocks in India have raised questions.

    NEW DELHI (TIP): The probe into the mega-billion ‘Coalgate’ scam moved into a higher gear with the Central Bureau of Investigation registering five FIRs into irregularities against five companies and several individuals, including a leading political family of Maharashtra.

    Those named in the first set of FIRs include Congress member of Rajya Sabha Vijay Jawaharlal Darda, his brother and education minister of Maharashtra Rajendra J Darda and his son Devendra. They have been accused of criminal conspiracy, suppression and misrepresentation of facts and violation of Prevention of Corruption Act.

    Apart from the Dardas, promoters of Nagpur-based Abhijeet group — Arvind Kumar Jayaswal, Manoj Jayaswal and Ramesh Jayaswal — have also been named in the FIRs. The group, which has clocked spectacular growth in recent years, was one of the biggest beneficiaries of controversial allocations of coal blocks.

    The FIRs named three companies belonging to the Dardas — AMR Iron and Steel (Nagpur), JLD Yavatmal Energy (Nagpur) and JAS Infrastructure Capital (Kolkata). The promoters of Navabharat Power, which has since become a subsidiary of Essar group, and Vini Iron and Steel Udyog, now controlled by an alleged aide of former Jharkhand CM Madhu Koda, figure in the remaining two FIRs.

    The agency is likely to file at least six more FIRs shortly, and enlist the cooperation of the Enforcement Directorate as part of a widening probe into the alleged swindle which surpasses the 2G scam in scale, and has jammed Parliament for over two weeks, placing corruption prominently on the national frontburner.

    CBI has also listed “unknown” government officials in the FIRs registered for cheating, criminal conspiracy and under many sections of Prevention of Corruption Act as preliminary investigations showed that some officials involved in the allocation process may have colluded with private players. The CBI teams carried out raids in Delhi NCR, Mumbai, Patna, Kolkata, Nagpur, Dhanbad, Ranchi, Hyderabad, Bhilai, Yavatmal and Raipur among others. They recovered several documents related to the cases and questioned officials including directors of the accused companies.

    The FIR against Navabharat Power accuses its original promoters, P Trivikrama Prasad and Y Harish Chandra Prasad, of fabricating facts to secure Rampia and Dipside Rampia coal blocks. The Prasad siblings later sold the company to Essar Power. The fifth FIR features Vini Iron and Steel Udyog Limited, with the CBI accusing Sanjeev Kumar Tulsyan, Prashant Tulsyan and five other directors as well as the company’s chartered accountant of making the false claim that they were part of a consortium. According to the FIR, the directors misrepresented facts in order to appear financially viable. Significantly, one of the directors, Vaibhav Tulsyan, said that they had sold the company to Vijay Joshi, a close aide of former Jharkhand CM Madhu Koda, five months before the block was allocated. The FIRs come when the confrontation between Congress and BJP looks set to intensify. Not surprisingly, CBI’s action evoked contrary responses from the two antagonists. Congress responded by suggesting that the law was taking its own course and that the government would ensure that the guilty don’t go unpunished.

    NEW DELHI (TIP): Even as the BJP stalled Parliament for the seventh consecutive day on Aug 30, the ruling UPA managed to get passed two important Bills in the Lok Sabha amid pandemonium. This was the first of piece of serious legislative work since August 22. In the Rajya Sabha, the BJP forced two adjournments at 11 am and noon before it was adjourned for the day at 2 pm. The two Bills were passed even as BJP members entered the Well of the House seeking resignation of the Prime Minister over coal blocks allocation. The Lok Sabha was adjourned for the day within minutes of the passing of the two Bills around noon. A Bill regulating chemical weapons in accordance with international convention and another to set up more AIIMS-like institutes were passed with voice vote amid sloganeering by BJP MPs. However, five other Bills-relating to money laundering, banking laws, protection of women against sexual harassment at workplace, North-Eastern reorganisation and the national institute of mental health sciences-could not be taken up. The All-India Institute of Medical Sciences (Amendment) Bill, 2012, will replace the ordinance that allowed six AIIMS-like institutes to become operational from September 15. The Chemical Weapons Convention (Amendment) Bill seeks to amend the Chemical Weapons Convention Act, 2000, on the prohibition of development, production, stockpiling and use of chemical weapons and their destruction

    NEW DELHI (TIP): Ahead of Chinese Defence Minister Liang Guanglie’s visit, New Delhi Thursday reiterated that Arunachal Pradesh was an integral part of India and backed freedom of navigation in South China Sea, a territory claimed by Beijing and other countries. China disputes the international boundary between India and China in the eastern sector and claims approximately 90,000 sq km of Indian territory in Arunachal Pradesh. China illegally refers to this region as ‘Southern Tibet’, Minister of State for External Affairs E. Ahamed told parliament. He was responding to a question by Rajya Sabha BJP MP Ravi Shankar Prasad whether China considered Arunachal Pradesh as the southern part of Tibet. “The fact that Arunachal Pradesh is an integral and inalienable part of India has been clearly conveyed to the Chinese side,” Ahamed said. The Chinese defence minister will be in India this week. Issues such as the Sino-Indian border, confidence building between the armed forces of the two countries and maritime cooperation are expected to be discussed. In a separate question , Ahamed underlined that India was not a party to the dispute over sovereignty over areas of South China Sea. ‘Sovereignty over areas of South China Sea is disputed between many countries in the region. India is not party to the dispute,’ Ahmed said in a written reply. ‘The government has said it supports freedom of navigation, right of passage and access to resources in accordance with accepted principles of international law and these should be respected by all,’ he said. He added that India wants that all these sovereignty issues should be resolved by the countries in accordance with international laws and practices.

    Gujarat Chief Minister Narendra Modi has been describing the large-scale killings of members of the principal minority community in 2002 under the very nose of his government as a “spontaneous reaction” of a people whose pride was hurt by the burning of train compartments in Godhra, resulting in the death of many “karsevaks”. Wednesday’s verdict of the Supreme Court-appointed special court convicting 32 persons, including a former minister in the Modi government, Dr Maya Kodnani, in the Naroda Patiya massacre case has proved the Chief Minister’s claim as false. The gynecologist, a BJP MLA since 1998, has been found involved in a “conspiracy” hatched by powerful persons that led to the Naroda Patiya riots, resulting in the death of 97 persons. Dr Kodnani was the Minister for Women and Child Development in March 2009 when she was arrested following a probe by the Special Investigation Team set up under the direction of the apex court. Another senior leader of the Sangh Pariwar convicted in the 2002 riots case is Babu Bajrangi of the Bajrang Dal.

    The special court’s verdict has come at a time when Mr. Modi is busy projecting his image as a secular leader of the BJP with an eye on the post of Prime Minister after the 2014 parliamentary elections. His supporters have been claiming that Gujarat’s development record shows that Mr. Modi can be the “ideal” candidate for the top executive post if the BJP-led National Democratic Alliance (NDA) emerges in a position to form its government. The conviction of the former minister may also affect the outcome of the December assembly elections in Gujarat, spoiling the chances of the BJP to recapture power under the leadership of Mr. Modi.

    The verdict is bound to bring into sharp focus once again the failure of the Narendra Modi government to prevent the massacre of innocent people in Gujarat in 2002. The court has also convicted three persons of being involved in gang rapes in Naroda Patiya, the second case in which this heinous crime has been proved after the Bilkis Bano case. The verdict has a larger message: India remains wedded to secularism, and those who attempt to disparage its image in the comity of nations will get their just deserts irrespective of how powerful they are.

    India’s Supreme Court on August 29 upheld the death sentence of Ajmal Amir Kasab, rejecting a plea by the lone surviving terrorist of the 2008 Mumbai attacks to commute the capital punishment.Observing that the primary and foremost offence that Kasab was charged with was waging war against India, the apex court bench comprising of justice Aftab Alam and justice CK Prasad passed the verdict saying, “We are left with no option, but to uphold the sentence.”

    Kasab wanted his death sentence pronounced by a trial court to be reversed.Following the verdict Kasab can now file a review petition in the Supreme Court within the next 30 days which will be examined by the same bench, on the rejection of which a curative petition can be filed, which will be examined by a different bench in the court.
    If the curative petition is also dismissed, Kasab can appeal for clemency and file a mercy petition with the President PranabMukherjee, who reach a decision based on a recommendation by the Union Home Ministry. Kasab had appealed to the Bombay High Court first which upheld the trial court order in October last year and now the Supreme Court also upheld the trial court order of May 2010. The court had earlier reserved the order after hearing the arguments of both the prosecution and defense counsels for more than two-and-a-half months. After the verdict, Special Public Prosecutor Ujjwal Nikam said the verdict is an important one. “I am very satisfied that for the first time we proved in a court of law that Kasab and his nine associates had been sponsored by Pakistan. Pakistan’s army and terror outfit Lashkar were behind it,” Nikam said. “Pakistan encourages terrorism and now if the country is serious about curbing it it should also act against those who were behind Kasab,” he said. In his judgment Justice Prasad said, “I am more than certain that the planning and conspiracy to commit the crime were hatched in Pakistan, the perpetrators of crime were Pakistani trained at different centres in that country, and the devastation which took place at various places in the city of Mumbai, were executed by the appellant in furtherance thereof.” Kasab argued that he was denied free and fair trial and he was not part of a larger conspiracy of engaging into a war against a nation. Kasab had filed the appeal from the prison that challenged his conviction and death sentence. Raju Ramachandran was appointed by the Supreme Court to represent Kasab as an amicus curiae. After the judgment, Ramachandran said he “bows before the verdict of the Supreme Court.” He said he was given full opportunity to say what he wanted in defence of Kasab. Union Home Minister Sushil Kumar Shinde on Wednesday said the government would see that if Ajmal Amir Kasab, the lone surviving Pakistani terrorist in 26/11 Mumbai attacks, files a mercy plea then it is disposed of in minimum time. “In case Ajmal Kasab files a mercy plea then we will ensure that it is disposed of in minimum time,” Shinde told reporters on Wednesday. Indian External Affairs minister S M Krishna on Wednesday said Pakistan should take ‘note’ of the Supreme Court’s decision that upheld the sentence of Kasab who had challenged the trial court verdict in the 26/11 attacks in Mumbai in the apex court. “The Supreme Court is the highest court; whenever it pronounces its verdict it becomes the law of the land,” Krishna told reporters in Tehran. “I am sure Pakistan did not fail to take note of the verdict,” he said. Politicians across party lines on Wednesday welcomed the Supreme Court’s decision on Kasab. Bharatiya Janata Party (BJP) leader Mukhtar Abbas Naqvi said: “The terrorists had challenged the security and peace of the nation. If there were more stringent punishments then it should have been given to him (Kasab). There should not be any delay in execution of the verdict.” Congress spokesperson Rashid Alvi said: “The entire country knew or I should say every country knew the role of Kasab, who had come to this nation from Pakistan. We have our own legal procedures. The Supreme Court upheld the decision. Everything became clear today. The world realized the situation.” Welcoming the verdict, Union Home Secretary RK Singh said: “In our judicial system everyone has opportunity to go to the highest court in the land.” “Mercy petition has not been filed,” he said while speakig on Kasab’s mercy plea issue. Kasab has been lodged in a Mumbai jail since being captured following the Mumbai terror attacks that left 166 people dead and over 300 injured. He had been convicted and sentenced to death by a trial court court in Mumbai and later by the Bombay High Court in February last year. Kasab was one of the ten Pakistan-based militants who launched coordinated strikes in vital places of India’s financial capital including two luxury hotels, a hospital, a Jewish centre and a railway station on Nov 26, 2008. Ajmal Kasab’s journey from petty crime to jihad He belonged to a poor family, in an impoverished part of Pakistan. Mohammed Ajmal Amir Kasab’s journey from crime to jihad and to India began after his father refused to buy him new clothes on Eid. Until then, the now 25-year-old Kasab — whose death sentence was upheld Wednesday by the Supreme Court of India – – led a simple life in Pakistani Punjab’s Okara district. His father was a food vendor while a brother was a laborer in Lahore. Kasab decided to quit home in 2005 after quarrelling with his father, who could not provide him new clothes because of poverty. The disgusted young man then took to petty crime, graduating to armed robbery. A chance encounter with Jama’at-ud- Da’wah, the political wing of Lashkar-e- Toiba, changed his life forever. It did not take long for him to sign up for training with the bitterly anti-India Lashkar. He was last seen in his village some six months before the November 2008 Mumbai attack. Apparently, he had sought blessings from his mother to wage jihad. Kasab was among the terrorists who underwent strenuous training that is said to have had the backing of Pakistan’s Inter- Services Intelligence (ISI) agency. The Lashkar reportedly offered to pay his family Rs.150,000 for his participation in the Mumbai attack — on the assumption that he would become a “shaheed” (martyr). Kasab and the nine other Pakistani terrorists sailed to Mumbai in two hijacked vessels with three targets in mind: the iconic Taj Mahal Palace Hotel, Oberoi Trident Hotel and Nariman House. Technology proved to be Kasab’s undoing. He was captured on CCTV when he unleashed mayhem at the crowded Chhatrapati Shivaji railway terminus along with fellow terrorist Ismail Khan. He was filmed carrying an AK-47, ammunition and dried fruit. Kasab and Khan then hijacked a police vehicle after killing, among others, Maharashtra Anti-Terrorism Squad chief Hemant Karkare. As they drove drove towards Metro cinema, Kasab reportedly cracked jokes about the bulletproof vests worn by the police. As fate would have it, one of the tyres suffered a puncture, so they stole another vehicle. This ran into a police barricade at Chowpatty. Kasab and Khan tried to make a U-turn. The alert policemen opened fire, killing Khan. A panicky Kasab pretended as if he was dead. But when assistant sub-inspector Tukaram Omble approached him, Kasab opened fire, killing him. Omble took five bullets but — in an act of bravery that made him a posthumous hero – – held on to Kasab’s weapon, enabling his colleagues to overpower him. The entire incident was captured on video — for posterity. Once in police custody, Kasab begged his interrogators to kill him, saying he feared for the safety of his family in Pakistan. He knew he had violated a cardinal jihadi principle: Never surrender. It was Kasab who first revealed that he and the other terrorists were in touch with their handlers in Karachi throughout the murderous mission. Pakistan initially maintained that Kasab was not a Pakistani. But the Pakistani media was the first to disprove the claim. Former Pakistan prime minister Nawaz Sharif confirmed his nationality. Kasab’s father eventually revealed that Kasab was his son. With nothing left to conceal, Islamabad finally admitted in January 2009 that the Urdu speaking man was indeed a Pakistani. In December 2009, Kasab retracted his confession. He said he had come to Mumbai to act in Bollywood films! Expedite 26/11… Asked about Zardari’s response to the demand for speeding up the 26/11 trial, Mathai quoted the president as reiterating his commitment to bring to justice the perpetrators but saying he was facing a judicial roadblock. Zardari, Mathai said, ‘mentioned they have had the processes taken up in the court and the court had taken a different view when the trial resumed. Thus, they have requested a repeat visit’ of the judicial commission that come to India to examine the witnesses in the trial of Ajmal Amir Kasab, the lone terrorist captured alive in the Nov 26-29, 2008 attack that claimed 166 lives. On August 29, the Indian Supreme Court had confirmed the death sentence handed to Kasab for his role in the attack. However, the Kasab issue did not figure in the meeting, Mathai said. Asked about Pakistan’s fresh request on the judicial commission, the foreign secretary said: ‘Earlier, the question was whether our processes would allow the questioning of the three indivduals (Pakistan) had sought. The home minister has said that let the visit take place.’ ‘This time, we will have to get a judicial view on whether cross-examination is possible,’ he said, adding that no time line had been set. Both leaders also felt that the meeting between the foreign ministers of the two countries early next month ‘would be an opportunity’ to chart out the roadmap for further dialogue. Trade issues were also discussed, with Zardari saying that given the ‘great scope for regional economic cooperation, Pakistan can be a catalyst in this process. The prime minister welcomed this approach,’ the foreign secretary said. Responding to a question on the US placing eight more members of the Lashkar-e-Taiba, including the son of its founder Hafiz Saeed, on the terror list, Mathai said: ‘We welcome all steps to combat global terror.’ India says Hafiz Saeed masterminded the Mumbai attack.

    New Delhi (TIP): Congress president Sonia Gandhi on August 23 told party MPs not to be defensive on the CAG report on coal block allocation as the government had not done anything wrong, and to aggressively counter the BJP’s demand for Prime Minister Manmohan Singh’s resignation.

    Gandhi, who met a group of Congress MPs including some first-timers, agreed with their suggestion that senior ministers of the party should convey the party’s stance on coal allocation through media interactions as the Bharatiya Janata Party (BJP) was not allowing debate in parliament.

    She agreed with the MPs’ suggestions that the BJP was trying to derive political mileage from the CAG report and the party should convey its stance aggressively, one of the MPs said. “She told us to convey the party’s viewpoint aggressively. She told us there is no need to be on the backfoot,” the MP said.

    He said Gandhi agreed with MPs’ suggestion that party should field senior ministers to convey the party’s viewpoint. Another MP said Gandhi agreed that the party should expose the BJP’s ‘obstructionist’ parliamentary tactics.

    ‘We met her to convey our viewpoint about how parliament is functioning. We told her that BJP was doing a disservice which should be taken to people,’ a party MP said later.
    The group met Gandhi soon after the Lok Sabha witnessed its first adjournment over the BJP’s demand and conveyed their anguish at repeated stalling of parliament’s proceedings over the Comptroller and Auditor General (CAG) report on coal blocks allocations.
