    Cabinet Clears Lokpal Bill With Amendments, Keeps Parties Out Of Its Ambit

    NEW DELHI (TIP): The Lokpal Billcleared by the Cabinet on January 31excludes political parties from itsjurisdiction and also rejects theproposal for the appointment of theCentral Bureau of Investigation chiefby a collegium comprising the PM,leader of opposition and the ChiefJustice of India.Minister of state for PMO VNarayanasamy informed the Cabinetthat political parties were being keptoutside the purview of the anti-graftombudsman as their functioning wascovered by the Representation ofPeople’s Act.The explanation is unlikely toconvince activist groups led by AnnaHazare and Arvind Kejriwal who feelthe bill falls well short of theirconcept of a strong and independentlokpal.

    The main opposition BJP isinsistent on a collegium deciding theappointment of the CBI chief ratherthan the consultative process set outin the bill that was examined by aselect committee of Parliament.Explaining the provision on theappointment of CBI chief,Narayanasamy claimed a clausealready existed in the Lokpal Billpassed by Lok Sabha. Asked why theselect committee made arecommendation which was alreadypart of the bill, he said, “Maybe thecommittee wanted to reaffirm itsstand on the issue.” However, the LokSabha version does not envisage acollegium.

    Bill may pass House test
    Official sources said the governmentis hopeful of the bill’s passage in theforthcoming budget session as the legislation will need a simple majoritythat the ruling coalition thinks it candrum up now that a controversialprescription for state lokayuktas hasbeen dropped.

    In the face of a strong publicsentiment in favor of accountabilityand opposition parties looking to putUPA-2 in the dock over corruptioncases, the government has travelled aconsiderable distance on the LokpalBill, conceding much more than it wasearlier willing to.The select committee’srecommendation to do away withmandatory sanctions required toproceed against senior officials hasbeen accepted with the caveat that theorganization or individual againstwhom an investigation report is filedwill be given an opportunity to presenthis case before a lokpal bench.

    This is a major concession as thebureaucracy has vociferously arguedthat this will strip officials ofprotection against motivatedcomplaints. However, the sanctionprocess has been used to delayprosecution, helping tainted officialsevade criminal proceedings aswitnesses are influenced and evidenceerased.The ombudsman will have aprosecution wing of its own but willnot have a say in the transfer ofofficials investigating a case taken upby it. The CBI will report to the lokpalwith regard to cases under lokpalscrutiny and the body will be able toask any relevant agency to take up aninvestigation.In all, the government accepted 14 of16 recommendations of the selectcommittee.

    On the committee’s view on lokpalapproval for transfer of CBI officersinvestigating cases referred by theanti-graft body, the government feltthis would affect smooth functioning ofthe investigating agency. The move is,however, seen as an attempt to keep ahold over officers of the agency.The bill excludes people “affiliated”with any political party from becomingmember of lokpal and keeps religiousand charitable organizations out of thepurview of the anti-graft body.Trusts like the one under yoga guruBaba Ramdev will, however, comeunder the purview of lokpal.Narayanasamy said, “Ramdev’s trust isnot a religious trust and therefore itwill definitely be under the lokpal.

    “The Rajya Sabha panel hadrecommended exclusion of bodies andinstitutions receiving donations fromthe public from the purview of lokpal.Since bodies receiving donations fromthe public were also covered in theoriginal Lokpal Bill, the governmentdid not accept the recommendation.However, at the same time, it decidedto exempt bodies or authoritiesestablished under a central or state Actproviding for administration of public,religious or charitable trustsregistered under the SocietiesRegistration Act.

    The approval of the officialamendments now paves the way forconsideration of the bill afresh by theRajya Sabha during the budget sessionexpected to begin towards the end ofFebruary.After getting a nod from the UpperHouse, the bill with amendments willgo back for fresh approval to LokSabha where it has already beenpassed.The government accepted therecommendation of the committee thatthe power to grant sanction forprosecution of public servants couldbe shifted to lokpal in place of thegovernment. It also agreed with therecommendation that lokpal may berequired to seek comments of thecompetent authority and the publicservant before taking such a decision.

    NEW DELHI (TIP): Alarmed over reports suggestingthat China proposed to construct three more dams onriver Brahmaputra in Tibet, India today asked Beijing toensure that the interests of downstream states were notharmed by any activities in upstream areas.Talking to reporters here, MEA spokesman SyedAkbaruddin said India continued to carefully monitorall developments on the Brahmaputra and has conveyedits “views and concerns” to the Chinese authorities,including at the highest levels.

    “As a lower riparian state with considerableestablished user rights to the waters of the river, Indiahas conveyed its views and concerns to the Chineseauthorities, including at the highest levels of theGovernment of the People’s Republic of China. Indiaurges China to ensure that the interests of downstreamstates are not harmed by any activities in upstreamareas,” he said.He was responding to a query regarding Chinaapproving construction of three more dams onBrahmaputra river in Tibet in addition to the one beingbuilt.

    A document approved by the Chinese Cabinet recentlymentioned three dams to be built at Dagu, Jiacha andJiexu on Brahmaputra, according to Indian officials inBeijing. The document listing projects to be completedin China’s 12th five year plan made a passing referenceto the three dams without any details, they said. Indiahas not been informed about the move so far.

    It condemned hiscomments that the BJP and RSS run terror training camps.The party has decided that its members and workers willboycott all public programmes in which Mr Shinde takespart,” BJP General Secretary Ananth Kumar toldreporters.The BJP will also not respond to any communication orrequest for meetings from Mr Shinde to the party’s seniorparliamentarians, including NDA Working Chairperson LKAdvani, and leader of the Opposition in the Lok Sabha,Sushma Swaraj.

    Shinde may find it difficult to getgovernment business through during the forthcomingbudget session of Parliament if the BJP does not respondto his calls for discussions on crucial issues.However, the BJP president said his party does notintend to boycott Shinde inside Parliament and will notdisrupt proceedings when he rises to speak.

    “But we willraise this issue (Mr Shinde’s remarks on Hindu terror) inParliament,” he said.Significantly, this strategy of the BJP appears to be aslight climbdown, as the party had earlier insisted thatPrime Minister Manmohan Singh and UPA ChairpersonSonia Gandhi should apologise for Shinde’s remarks andthat he should be sacked from the post of home minister.

    The home minister had alleged during the CongressChintan Shivir in Jaipur last month that the BJP and RSSwere involved in training their cadre in terror activitiesand those allegedly involved in Hindu terror acts wereaffiliated to them.

    NEW DELHI (TIP): “Vishwaroop”, the Hindi version ofactor-director Kamal Haasan’s controversial film”Vishwaroopam”, released peacefully on February 1 toan average response, which was likely to pick up overthe weekend.The movie, the original Tamil and Telugu version ofwhich is currently banned in Tamil Nadu, releasedwithout any hassles in Delhi, Punjab and Rajasthan,while in Uttar Pradesh and Mumbai, security wasbeefed up at cinema halls for the release over fear ofprotests.

    “Vishwaroopam” is under the scanner of 24 Muslimorganisations, which objected to certain scenes of thefilm as derogatory to their community.However, the situation seems to have sparkedincreased interest in the movie in north India.In Delhi, the response was okay, but the collectionsare expected to increase during the weekend, says AnantVerma, director and business head, DT Cinemas.”Whoever has seen the movie has liked it – be it peoplefrom south India or north India.

    The publicity that themovie has got is working in favour of the movie. We areexpecting a hike (in collections) over the weekend,”Verma said. He says no security issues have beenreported at any of his halls here so far, and “everythingis under control”.”The occupancy for the first show was around 55 to 60per cent, but that is how it is every (early) Friday. Thefilms start picking up from Friday evening,” he added.Delhi-based distributor Joginder Mahajan admits thestart for “Vishwaroop” is “poor”, but “it is expected togrow over the weekend”.He pointed out how “since there has been so muchcontroversy, people avoid going on the first day”.

    In east Punjab, the film’s opening was below average,informed distributor Jaspal Dhingra of NanaksarEnterprises. “The response to the first show was belowaverage. The film may be good, but collections are veryaverage. Generally, dubbed films from south India don’tdo well in Punjab. There are very few people here whowant to watch the movie,” Dhingra said.”As far as security is concerned, there were no issueshere and I don’t think there will be any problems in thefuture too,” he said.

    In Jaipur, the film got a peaceful opening and therewere are no protests, said police officials.Meanwhile, Kamal Haasan and his brother ChandraHaasan are trying to reach a solution to end the ban on”Vishwaroopam” in Tamil Nadu, which has led to theirincurring losses of Rs.30-60 crore.

    NEW DELHI (TIP): The UnionCabinet on February 1 approved thepromulgation of an ordinance thatintroduces tougher jail terms forcrimes against women, includingdeath penalty for extreme cases ofsexual assault.The Cabinet meeting chaired byPrime Minister Manmohan Singhdiscussed the Justice VermaCommittee report, whichrecommended a series of measures tomake crime against women laws morestringent. The three-member panelwas set up after national outrage overthe gang-rape and brutal assault of a23-year-old trainee physiotherapist ina moving bus in the National Capitalon the night of December 16.With the Cabinet approving theordinance, the government will nothave to wait for the budget session ofParliament to commence on February21 to amend the law.

    Though theordinance will allow changes in law, itwill have to be passed in Parliament.Once the budget session starts, thegovernment will have to table a Bill toreplace the ordinance.The ordinance could bepromulgated over the weekend,sources said. It would have to beapproved by the President before itbecomes a law.The Cabinet has recommendedinclusion of death sentence or a jailterm spanning the convict’s lifetime inextreme cases. The severity of thecrime in order to categorise it as an“extreme case” will be detailed in theordinance. It may include cases werethere may be bodily harm to thevictim that left her in a vegetativestate or seriously injured.Other cases of rape will attract aprison term of up to 20 years.

    Theword ‘rape’ will be replaced by theword ‘sexual assault’. However, thegovernment has omitted arecommendation by the Justice JSVerma committee to make maritalrape a part of sexual assault.Stalking a woman, acid attacks,trafficking and harassment at workplace will be covered under sexualassault, as per the tonight’s decision,and attract graded punishments. Tillnow, stalking, acid attacks andtrafficking were not defined undersexual attacks. Thousands of womenare stalked daily across the countryand incidents of acid attack arereported frequently.The Justice Verma panel suggestedradical changes in rape laws in its 630-page report submitted in 29 days.Despite demands to include deathpenalty for convicted rapists, it didnot recommend capital punishment,saying that even women fighting onthe issue for years were against it. Ithad received over 80,000 suggestionsfrom all over the country on change inlaws.

The 16-years-old made their first and last publicperformance at the ‘Battle of Bands’ here lastDecember where they gave bands that mostlycomprise of boys a run for their money.But days after their debut, the band decided tocall it quits.

    The reason: a vile barrage ofabuses and hate messages about them and theirfamilies on the Internet, strong enough to forcethe young teen into hiding and abandoning theirdream.One of the girls, who talked to The Tribune onthe condition that she would not be named, saidthe band had “ended”, but was reluctant to givereasons for the decision. “We have closed. It justended… we had to hear so much from societythat is why… I don’t want to tell anyone thereason,” she said.

    The girl’s mother said she cried through thenight after reading comments about the band ona social networking site. “The girls’ pictureswere uploaded on a Facebook page and opinionswere sought on whether making a band waswrong or right for our girls.Some people wrote that the girls’ families hadno food, which is why they were out to earn.After reading the comments, my daughter gotvery upset and cried all night. She decided notto do it again,” said the girl’s mother, addingthat the family tried to talk her out of herdecision.

    According to the girl’s mother, someposts appreciated the band; others didn’t. “Ourreligion does not allow this, our society doesn’tallow this,” she said. ‘Pragaash’ was a milestonein Kashmir’s music history for being the firstrock band where the guitarist, drummer andvocalist were all girls. Women have enjoyedsuccess in Kashmir singing folk songs, mysticpoetry and romantic songs, but what set‘Pragaash’ apart was its genre.Band guitarist Aneeka Khalid, however, saidthe band had not been disbanded.

    KATHMANDU (TIP): Teachers backed by the breakaway CPNMaoistfaction in Nepal have forcibly shut down a local schoolallegedly for including Indian course syllabus as part of theircurriculum.Some 3,000 students have been left in the lurch after the DAVSushil Kedia Vishwa Bharati Higher Secondary School situatedin Lalitpur district was locked up by the school’s teachers’ unionaffiliated to CPN-Maoist led by Mohan Vaidya, the breakawayfaction of UCPN-Maoist.

    Although the teachers’ union apparently acted in protestagainst the sacking of two teachers of the school, the schoolmanagement says the real reason behind the closure is theinclusion of India’s CBSE course syllabus in the schoolcurriculum.The teachers’ union have locked up the school since January 6,according to the management.They have also threatened retaliation if the locks are openedwith the help of administration.There are some 14 schools in Nepal which have beenconducting CBSE examinations for more than a decade.

    The teachers’ union has been threatening schools againstincluding Indian curriculum saying that it goes against thenational interest.They have also demanded scrapping of the CBSEexaminations.”We are trying to hold dialogue with the agitating teachers andwe hope that the issue will be settled through dialogue,” saidprincipal of the school, Bhubaneshwari Rao.Last year, CPN-Maoist had imposed a ban on screening ofIndian movies and entry of vehicles with Indian number plates.

It shut down one attack moments after itwas detected.But it discovered that the attackers may have gainedaccess to usernames, email addresses and encryptedpasswords belonging to 250,000 users.

    Twitter has resetthe pilfered passwords and sent emails advising usersthat they’ll have to create a new one.”This attack was not the work of amateurs, and we donot believe it was an isolated incident.     WASHINGTON (TIP): A bipartisan groupof top US Senators has introduced alegislation in the Senate aiming at severalchanges in immigration norms, includingdoubling of H-1B visa cap and establishing amarket-based escalator.The other proposed measures includerecapturing of unused Green Card numbers,eliminating country cap and recommendinga series of new provisions to provide legalpermanent residency to talented andbrilliant.Introduced by Senators Marco Rubio,Orrin Hatch, Amy Klobuchar, TheImmigration Innovation (I2) Act of 2013proposes to increase H-1B cap from 65,000 to115,000 and establish a market-based H-1Bescalator, so that the cap can adjust to thedemands of the economy.The bill includes a 300,000 ceiling on theability of the escalator to move.

    If the cap is hit in the first 45 days whenpetitions may be filed, an additional 20,000H-1B visas will be made availableimmediately.If it is hit in the first 60 days whenpetitions may be filed, an additional 15,000H-1B visas will be made availableimmediately and if the cap is hit in the first90 days when petitions may be filed, anadditional 10,000 H-1B visas will be madeavailable immediately.In case the cap is hit during the 185-dayperiod ending on the 275th day on whichpetitions may be filed, and additional 5,000H-1B will be made available immediately, thebill proposes and calls for uncapping theexisting US advanced degree exemption(currently limited to 20,000 per year).The legislation focuses on areas vital tokeep US competitiveness intact in the globaleconomy.

    It proposes increased access to GreenCards for high-skilled workers by expandingthe exemptions and eliminating the annualper country limits for employment basedGreen Cards.The legislation also aims at reforming thefees on H-1B and Green Cards so those feescan be used to promote American workerretraining and education.Furthermore, it authorizes employmentfor dependent spouses of H-1B visa holders,thus meeting a long pending demand.It also proposes to increase portability ofhigh skilled foreign workers by removingimpediments and costs of changingemployers, establishing a clear transitionperiod for foreign workers as they changejobs, and restoring visa revalidation for E,H, L, O, and P non-immigrant visacategories.

    The legislation, if passed by the Congressand signed into law by the US President,will enable the recapture of Green Cardnumbers that were approved by Congress inprevious years but were not used.It will exempt certain categories ofpersons from the employment-based GreenCard cap, including dependents ofemployment-based immigrant visarecipients, US STEM (Science, Technology,Engineering and Math) advance degreeholders, persons with extraordinary abilityand outstanding professors and researchers.The legislation also provides for the rolloverof unused employment-basedimmigrant visa numbers to the followingfiscal year so that future visas are not lostdue to bureaucratic delays, and eliminateannual per-country limits for employmentbased visa petitioners and adjust percountrycaps for family-based immigrantvisas.

    The legislation calls for reformingfees on H-1B visas and employment-basedGreen Cards and use money from these feesto fund a grant program to promote STEMeducation and worker. “Our immigrationsystem needs to be modernized to be morewelcoming of highly skilled immigrantsand the enormous contributions they canmake to our economy and society,” saidSenator Rubio.”This reform is as much aboutmodernizing our immigration system as itis about creating jobs.     NEW DELHI: Growth in the country’s manufacturing sector slowed to a three-month low in January due to the impact of easing orders and power outages, a survey showed on Friday.

    The HSBC Purchasing Managers’ Index (PMI) – an indicator aimed at providing a snapshot of operating conditions in the manufacturing sector – posted 53.2 in January, down from 54.7 in December. The December reading was a six-month high on the back of solid orders. The latest reading signalled a further improvement in the health of the Indian manufacturing sector.

    But the improvement was slower, the survey said. The Indian manufacturing sector has been hit hard by the slowing economy, weakening global growth, high interest rates, stubborn inflation and rising input costs. Continuing the trend that started in April 2009, output at manufacturers in India rose during January.

    While solid, the rise in production was the slowest recorded in three months amid evidence from the survey panel that ongoing issues with the supply of power had restricted growth, according to the PMI survey. “The growth momentum in the manufacturing sector eased in January as a slower expansion in new orders and power outages slowed output growth,” said Leif Eskesen, chief economist for India & Asean at HSBC. “To meet new orders, manufacturers still rely on a draw down in stocks of finished goods, which should provide support for output growth in coming months as stocks are replenished,” Eskesen said.

    The survey said input and output prices both increased in January, with rates of inflation again marked. Input costs rose for the forty-sixth successive month, with respondents indicating that fuel and raw material prices had increased.

    Output charges were raised to protect margins in the face of higher costs, it said. “Encouragingly, input and output price inflation continued to ease, albeit only gradually, supporting the case for RBI’s cautious policy rate cut earlier this week,” Eskesen said. The RBI has reduced the repo rate and the cash reserve ratio to help support growth but has cautioned about the inflationary pressures prevalent in the economy. The volume of incoming new work expanded in January, the forty-sixth consecutive monthly increase recorded.

    Over one-fifth of the survey panel indicated higher levels of new orders, citing stronger demand and maintained product quality. Total new business rose solidly, although growth eased from December. New export orders increased for the fifth consecutive month, and also at a solid rate.

    Panel members stated that demand from foreign clients was higher. In line with stronger sales, manufacturers in India increased their input buying in January. The overall rate of growth, although solid, eased to a three-month low.

    The survey showed staffing levels in the manufacturing sector increased during January, amid reports of higher workloads but the pace of job creation was slight and unchanged from December.

    MUMBAI (TIP): The government on Friday raised about Rs 3,100 crore through the divestment of 10% stake in Oil India (OIL), selling about 6.01 crore shares of the state-owned oil explorer at Rs 520 per share.

    The issue, which was open only for the day, generated a demand for about 15.4 crore shares, translating to an oversubscription of nearly 2.6% times. The OIL stock in the regular market closed at Rs 526, down 2.5% on the day.

    Post this sale, the government’s holding in the company will fall to about 68%, a shareholding level for the company that now confirms to Sebi-mandated compulsory public holding of 25%.

    The divestment in OIL also forms part of the government’s Rs 30,000 crore selloff target. The OIL divestment was also the government’s first sell-off in 2013, that last being the divestment in NMDC in December 2012. Market players said that the divestment in OIL, through the offer for sale (OFS) route, showed revival in investor interest for public offers.

    The success of the OFS issue also came on the back of government’s recent decision to partially deregulate diesel prices, which in turn could bring down the subsidy burden of the oil companies like ONGC, OIL, Indian Oil and other government-run companies in the oil & gas sector. The success of the issue may now prompt the government to launch similar offers for NTPC, SAIL and MMTC

    MUMBAI (TIP): Cheque books may go the way of physical share certificates if proposals mooted by the Reserve Bank of India (RBI) are enforced. In a discussion paper on discouraging cheque usage, RBI has proposed charges for individuals when payments are made by cheques and penal processing fees for institutions that continue to issue warrants rather than credit amounts to investors’ accounts directly. RBI also wants every entity making or receiving bulk payments to move to direct electronic transfers to recipients’ bank accounts.

    Interestingly, the panel has found that one of the biggest culprits standing in the way of electronification of payments are banks themselves with their demand for post-dated cheques from borrowers.

    The paper points out that at present, the cheque issuer (drawer) does not bear any charges for issuing a cheque and proposes that the drawer is made to bear some charges when cheques are issued. “Such charges may be levied on an advalorem basis at par with charges applicable in electronic payment systems.

    Similarly, cheque collection charges may also be reviewed and charges levied (on the payee or beneficiary of the cheque) even for local cheques beyond certain amount limits.

    In case of corporates, charges may be levied irrespective of amount limits for cheques deposited into their current account considering the expenditure incurred by the collecting bank,” the paper said. The discussion paper comes out two months before RBI is set to roll out its cheque truncation system.

    Under this, cheques will be dematerialized after they are received by the bank and only their images transmitted for settlement.

    NEW DELHI (TIP): The latest quarterly performance of the three publicly-listed telecom companies — Bharti Airtel, Idea Cellular and Reliance Communications (RCOM) — shows early signs of a pick up in data-driven revenue, helped by higher number of subscribers using data. Besides, operators are in the process of consolidating voice-based business by reducing the number of accounts that do not meet regulatory requirements.

    This has resulted in improved per user parameters. This, coupled with tariff hikes by telcos a few weeks ago, highlights a positive undertone about future revenue and profit growth. However, the nearterm pressure on margins is expected to continue as companies would strive to cut debt burdens, reduce interest outgo, and rationalise network operating costs.

    The pressure on profitability was visible from the performance of operators in the December 2012 quarter. The three operators reported a drop of 30-70 basis points (bps) in margin at earnings before interest, tax, depreciation, and amortisation (EBITDA) margin level. This is despite a moderate revenue growth. For Bharti, though revenue remained flat sequentially, it rose by over 3% after adjusting for one-time gain recorded in the previous quarter.

    WASHINGTON (TIP): A gap in the Antarctic ozone layer has impacted the way the waters in the southern oceans mix, with the potential to alter the amount of atmospheric CO2 and possibly affect climate change, warn scientists. Darryn W. Waugh, from the John Hopkins Kriegar School of Arts and Sciences, said: “This may sound entirely academic, but believe me, it’s not.

    This matters because the southern oceans play an important role in the uptake of heat and carbon dioxide, so any changes in southern ocean circulation have the potential to change the global climate.” Waugh’s team used measurements taken from the early 1990s to the mid-to-late 2000s of the amount of a chemical compound known as “chlorofluorocarbon-12,” or CFC-12, in the southern oceans, the journal Science reports.

    CFC-12 was first produced commercially in the 1930s and its concentration in the atmosphere increased rapidly until the 1990s when it was phased out by the Montreal Protocol on substances that deplete the ozone layer. Prior to the Montreal Protocol, CFC-12 was used in products such as aerosol hairsprays and refrigerants and in air conditioning systems, according to a Johns Hopkins’ statement.

    From those ocean measurements, Waugh’s team was able to infer changes in how rapidly surface waters have mixed into the depths of the southern oceans. Because they knew that concentrations of CFCs at the ocean surface increased in tandem with those in the atmosphere, they were able to surmise that the higher the concentration of CFC-12 deeper in the ocean, the more recently those waters were at the surface.
