    4 dead, 4 wounded in Dallas-area shootings

    DALLAS (TIP): Police were trying to determine Thursday, August 8 what prompted fatal shootings in two Dallas-area homes that left four dead and another four wounded. Investigators arrested a suspect, Erbie Bowser, 44, at the scene of the second shooting, which took place late Wednesday. Police say the shootings began around 10:30 p.m. Wednesday at a Dallas home, where two people were killed and two others were injured, according to the Dallas Morning News.

    Two more people were killed and two children were wounded at a second home in DeSoto, where police said a hand grenade was thrown into the living room before the shooting began, the Morning News reported. Police did not immediately release the identities of those killed and wounded, and the conditions of the survivors were not known Thursday. A neighbor in DeSoto, Tommy Johnson said that he heard a loud boom Wednesday night. “I peeped out the front, and that’s when I saw a bunch of officers walking down the sidewalk and about 10 houses up,” Johnson said. Police would not confirm that a grenade or other explosive device had been used in the DeSoto attack, pending the results of a federal and Dallas bomb squad investigation.

    SACRAMENTO (TIP): Geneva Liberty Group’s event “1984 Day Rally to ‘Restore the Fourth’ amendment attracted about sixty attendees on August 4th, 3:00-5:00 PM, at Cesar Chavez Park located in heart of the Downtown of Sacramento. The nationwide movement ‘Restore the Fourth’ has been drawing attention of people against the National Security Administration’s surveillance program to preempt any threat to America.

    The rally was one of about 50 peaceful demonstrations in cities across the country. Pieter Singh, one of the organizers, declared that the rally was to correct ongoing oppression of N.S.A, and rebuke the oppressor boldly. “Our organization seeks to secure individual liberty as the solution to ills affecting mankind, support self-government, and oppose oppression anywhere in the world.”

    It is believed the movement originated on Reddit hardly a month ago. NSA’s unreasonable searches and seizures, almost all speakers emphasized, violate Fourth Amendment. Steve Macias, executive director of Cherish California Children and vice president of California Assembly referred to George Orwell’s novel, Nineteen Eighty- Four, to highlight tendency of the Obama administration for a totalitarian control of Americans’ liberties. Most speakers acknowledged Bradley Manning and Edward Snowden as keepers of Americans’ conscience in exposing the surveillance program of the federal government. India born, Eric Arthur Blair wrote under pseudonym of George Orwell. As a member of the British India’s intelligence service, Orwell had witnessed tampering of India’s history and languages.

Referring to Dr. Bhimrao Ambedkar, a giant intellectual luminary of Columbia University, New York, Bhinder said that he fought relentlessly to abolish caste system of India as necessary for a healthy global society. Joel Beall and his associates in the end entranced the audience with playing of Berembau, a Brazilian musical instrument. Capoeira, a dance form most common with Berembau, the percussion instrument, demonstrates a martial and rebellious spirit in its movements.

    SAN FRANCISCO, CA (TIP): T-Mobile US, the fourth-largest American carrier, lost thousands of customers over the past few years to rivals that offered cooler phones. But it appears to be getting its groove back, a report in New York Times says. The company on Thursday,August 8, said it had gained 1.1 million customers, including 685,000 contract subscribers, over its second quarter.

    That compares with losing 557,000 contract subscribers, the most valuable type of customer, in the same period a year ago. The uptick represents its largest customer growth in four years. The company, based in Bellevue,Wash., only started offering the iPhone in April,when it also began offering new phone plans that address common frustrations with wireless companies, like confusing contracts and expensive data plans.

    “By fixing the things that drive them mad, like contracts and upgrades, and freeing them from the two-year sentences imposed on them by our competitors, they are choosing the new T-Mobile in unprecedented numbers,” John Legere, the chief executive of T-Mobile US, said in a news release. Over the last several years, T-Mobile lost many customers largely because it lacked the iPhone, and customers were unhappy with its service. But this year has been jam-packed with change for the company: it finally landed a deal with Apple to sell the iPhone, it began an overhaul of its network and it started offering lower-cost plans to lure customers from competitors.

    The company also has extra muscle from its merger with the smaller carrier MetroPCS,which was completed in May. The change is costing T-Mobile. The company posted a loss of $16 million for the quarter, compared with a profit of $207 million last year in the same period. But it also reported revenue of $6.23 billion, up from $4.9 billion last year. (The majority of the company is still owned by Deutsche Telekom, the German carrier. This quarter was the first time T-Mobile US reported earnings as a separate company after its merger with MetroPCS.) The net income was above the expectations of Wall Street analysts. They had expected revenue of $6.01 billion, according to a survey by Thomson Reuters.

    In March, T-Mobile discontinued two-year contracts, instead allowing customers to buy a smartphone for a lower upfront cost and adding the cost of the device to their monthly bill. It also continued to offer plans with unlimited data, an option that the top two carriers, Verizon Wireless and AT&T, killed years ago. In general, T-Mobile’s plans are also cheaper than its competitors’ – for $70 a month, a customer can have unlimited minutes, text messages and data. The plans offered by AT&T and Verizon cost upward of roughly $100 a month. T-Mobile expects the growth to continue. For the full year, it said it expected to add between 1 million and 1.2 million contract subscribers.

    Sir, This is to express our condemnation of your plan to meet with Pakistan’s Prime Minister Nawaz Sharif during upcoming UN Assembly meeting in New York. We are wondering what has changed since the26/11 attack to call for this measure? The infiltration attempts have been doubled this year, and Pakistan Army’s daring overtures have only seen an upsurge. With terror activities on the rise, your meeting with PM Sharif will only embolden Pakistani Army and ISI’s resolve to ‘bleed India with a thousand cuts’.

    The Indian diaspora was outraged by the unfortunate and uncalled for dilution of the army statement by Defense Minister A K Antony, giving clean chit to Pakistan in the brutal and provocative killing of five Indian soldiers on August 6th, 2013. This grave mistake was later corrected; however, some concrete action remains yet to be seen. Our heart goes out to the families of the brave soldiers for their loss. The loss of these five soldiers, namely, Naik Prem Nath Singh (21 Bihar Regiment), Lance Naik Shambhu Saran Rey (21 Bihar Regiment), Sipahi Vinay Kumar Rey (21 Bihar Regiment), Sipahi Raghu Nandan Prasad (21 Bihar Regiment) and Naik Pundalik Mane (Maharashtra Regiment), is a loss for a proud nation, and its every citizen.

    Instead of taking tough action against the perpetrators of this action, i.e. Pakistani Army and terrorists, government seems to be giving a clean chit to them. Immediately after the incidence Indian Army’s official briefing directly held Pakistani Army responsible for the dastardly act (press release # PRO/Jammu/425/Aug/2013). After this, Defense Minister Antony gave a statement in Parliament (press release # PRO/Jammu/426/Aug/2013) which took out the name of Pakistan Army. In another significant change he changed the location of the incident from “close to the Line of Control” to “our side of Line of Control”.

    Then in a clarification Mr. Antony said that he was not aware of the ground situation, and awaits an update from the Indian Army officers visiting the ground. If Mr. Antony was not aware of the ground situation, what was the need to give a statement in the parliament? Wasn’t this an irresponsible and demoralizing action for our soldiers and for our country, that knowingly we are avoiding calling the enemy by name? A similar incident took place on January 8th when two soldiers from 13 Rajputana Rifles, namely Lance Naik Hemraj and Lance Naik Sudhakar Singh, were killed and beheaded. Their heads were taken as trophies, and the perpetrators were openly rewarded inside Pakistan.

    Just one week after the incident, External Affairs Minister Salman Khurshid invited the Prime Minister for Chicken Biryani at his place. How can these treacherous and demoralizing acts be justified to the bereaved families of martyred soldiers? Particular when these acts are done by sitting ministers of the central government, who have no concrete measures to offer – except for cheap talk. It was proven beyond doubt that Ajmal Amir Kasab, one of the 26/11 attackers was a Pakistani national.

    It has been widely reported that India’s most wanted terrorist Dawood Ibrahim is living in Pakistan under military protection. Osama Bin Laden was found living near the army cantonment. The dubious dealings of Pakistan’s Army and ISI are known to everyone, and the proxy war they are waging against India is beyond doubt. Yet Government of India seems very wishy washy about these acts and moving forward with business as usual as if nothing has happened.

    We, as students, professionals and responsible citizens of India, unequivocally condemn these acts of terrorism, and their weak and demoralizing responses by the Government of India. By failing to curb these terror activities, by failing to give a fitting response, and by continuing normal relations with Pakistan you are not only hurting the moral of the nation, but also encouraging our enemies to continue these activities.

    We hope that you will take strongest possible measures to ensure safety of our borders, our soldiers, and our regional and geopolitical interests. We truly hope that members of your cabinet will be more sensitive in their actions, and careful in their professional conduct so as not to demoralize the citizens and soldiers of our country. Lastly, we emphatically call for a cancellation of your meeting with Pakistan’s Prime Minister. We firmly believe that unless there is peace on our borders and a significant reduction in terror activities – for an extended duration, relationships with Pakistan should be put on hold at all levels.     Kanwar Sandhu is synonymous with journalism in Punjab. Beginning his career with “The Tribune”, the region’s leading English daily published from Chandigarh he was soon spotted by “India Today”, India’s leading news magazine. During the days of insurgency in Punjab, he frequently wrote investigative reports about the militancy afflicting the state. During this period of turmoil his name and fame spread far and wide.

    Later the “Indian Express” picked him up as the resident editor of the Chandigarh and Punjab edition of the national newspaper. His reporting and writings always covered all aspects of the story, including the often ignored opposition’s point of view. This was appreciated by the newspaper readers of the region. When “Hindustan Times” launched its Chandigarh edition, they entrusted the resident editorship of the newspaper to Kanwar Sandhu. In 2010, a Chandigarh based business house expressed its desire to launch a news channel from Chandigarh. Kanwar Sandhu offered his services as the managing editor.

    On August 11, 2010, a twenty four hour trilingual (Punjabi, Hindi and English) news channel, known as DAY & NIGHT NEWS was launched with a lot of fanfare. This news channel was very different from the other channels in the region. It gave full coverage to all the divergent political points of view. The people in power did not like his independence. They wanted their side of the story only to be carried. Within two months, the powerful cartel of cable operators in Punjab started harassing this channel.

    At times their sound was cut and at other times the picture was scrambled. After sometime, the channel was forcibly withdrawn from all cable systems in Punjab. This channel approached the Punjab and Haryana High Court, which ruled in favor of the channel. In spite of the orders of the high court, the powerful cartel of cable operators in Punjab known as FAST WAY Communications did not let this channel get on to the cable systems in Punjab. The advertisers were forced not to give commercials to this channel.

    This adversely affected the fiscal health of the channel. Initially carried by six DTH dish platforms, this channel got confined to just two i.e. DD Direct+ and Dish TV. On August 1, 2013, the financiers of the channel, citing reasons of fiscal difficulties, refused to pay dues to the remaining two dish platforms also. Seeing no platform on which this channel could be seen, Mr. Kanwar Sandhu was forced into resigning. Along with him, a lot of senior staff also resigned. There are rumors that Kanwar Sandhu was ousted by the people in power in Punjab for refusing to toe their line. In April 2013, Kanwar Sandhu launched a new phone-in program for the viewers in North America. The name of the show was “HELLO NORTH AMERICA”. This program became instantly very popular. Sandhu was flooded with lots of calls and e-mails from all over the world.

    Most callers were highly critical of the Punjab Government. The people in power did not like this and now we see Mr. Kanwar Sandhu has been ousted from a news channel, which was his own baby. Mr. Kanwar Sandhu has paid the price for his honesty, fair mindedness and brilliance. After Kanwar Sandhu’s ouster it appears that light has gone out of the channel. The editorial policy of the channel has changed from absolutely fair stand to all to pro- Punjab Government. Now there is no channel in Punjab, which can dare to criticize the government for its wasteful and flawed governance.

    The state government wanted all Punjabi TV channels in Punjab to be completely pliant and by hook or crook they have subjugated the last citadel of independence in Punjab. Now the tyranny will increase and no one will be able to raise the voice of dissent. We are claiming that India is a democracy, but in actuality we are heading towards a feudal autocracy.     Pakistan and the killings across the LoC: Tactical Offensive or a Strategic Defensive?

    “The fragile peace between India and Pakistan is once again under threat, but this time, the unease and tension may not be between India and Pakistan but between Pakistan and Pakistani Military establishment”, says the author.

    The recent killing of five soldiers in Poonch has reverberated the calculated and tested strategy of the Pakistan Army once again. Pakistan’s dubious track record of such events since the killing of Captain Saurabh Kalia and five other soldiers in May 15 1999 to the killing five of our brave men on Aug O5, 2013, inside our LoC are indicative of a revival of such dehumanization. The emotions and concerns raised by the nation each time may well be justified, but undue intensity in responses and reactions may often go to consolidate success of the perpetrators.

    In a contextual perspective, recurring events of this nature fall in line with the processes of authorization, routinization, and dehumanization, used by Kelman and Hamilton in studying My Lai and related events, to explain the dimension of Pakistan’s Military psychology. Pakistan military can learn from its record of atrocities in Bangladesh with larger ramifications of isolation in international relations, a possibility that Nawaz Sharif Government cannot allow.

    At a tactical level, Pakistan’s military psychology may be seen focused on a sense of achievement vis a vis India within the vacuum created by enormous disparities of conventional combat power or as a moral ascendancy/supremacy in the prevailing imbalance. While the dare exhibited in this raid may certainly be a shot of Adrenaline for the Pakistani military, but this may not be without a risk of escalation. India therefore, cannot and need not be cowed down by the hyped responses and talks of nuclear retaliation built up by Pakistani military establishment, to any action taken by the Indian Military and reiterated by every single Pakistani participant during television debates or panel discussions .

    Perhaps Our responses need to be fearless, timely and appropriate at the tactical level, and beyond glare of the media. While objectives of such or similar actions identified by India’s Security and Defence Experts during recent debates and discussions are extremely relevant, the outcome intended this time may well be more subtle and strategic. It is pertinent to bring here the internal security dynamic and declining influence of the Pakistani Military in the post elections scenario. The divergence in the civil military relationship between the Army, the PML-N and PTI on several security issues has been increasing .

    India’s role in Afghanistan, and cooperation between India and Pakistan towards peace and tranquility may well be the most serious differences that may threaten peace. In its first steps towards its strategic objectives of return to constitutional hierarchy, the Government’s focus is on the place of the Military denying it its traditional space of decision making on national issues.

    The federal government’s recent decision to initiate a high treason case against former military dictator Pervez Musharraf for subverting the constitution of Pakistan twice, which led to exile of Nawaz Sharif, and landing the shame/ humiliation of Kargil upon Pakistan are significant . Commencement of investigations , fully supported by the PTI and PPP’ have added to concerns of the Military , as any such prosecution would threaten many to similar fate. Silence of the Army chief, General Kayani during the entire process of campaigning and elections, and of keeping the Taliban at bay while propagating opportunities of their conditional return to main stream, while a step in the good and orderly direction, was viewed with serious reservations from many quarters within the Army.

    The implicit intent of the civil government may well be the nemesis of the Pakistan Army from a place of pre eminence and control, to a place of irrelevance or relative insignificance. The only field left where the Military can draw or perhaps redraw its significance is the LoC and issues of terrorism that may turn focus from civilian engagement to military incidents that tend to rally nations and people against each other reversing the entire process of restoring peace.

    Katharine Houreld from Reuters on 20 May this year, quoted Lieutenant Talat Masood who viewed the past five years significant in this context , in that, while the military remained the most powerful force behind the scenes, it no longer wanted to take direct power, Musharraf, the last military dictator, was in detention, Generals had been hauled up before Pakistan’s feisty courts and accused of voterigging, corruption and extrajudicial killings. The army does not have the monopoly of the power it once did.

    With a judiciary supportive of the Prime Minister s and a pro government media, an Army with a reformed, pro-democracy mindset, will complement the underpinnings for change in the overall environment in both Rawalpindi and Islamabad. Towards this, Nawaz Sharif will have to address the singular and greatest obsession of the Pakistan Military leadership and the rank and file, from its perceptions of India being the entire reason de etre of its existence to one of relevance in the national interests and internal contingencies. The fragile peace between India and Pakistan is once again under threat, but this time, the unease and tension may not be between India and Pakistan but between Pakistan and Pakistani Military establishment. For the latter, it may be a last strategic defensive for the Military’s relevance than a tactical victory vis a vis India.

    India needs to do a little plain speaking with Pakistan. For decades now Pakistan has been trying to bleed India every now and then. The long history of Pakistani insensitivity to good neighborly relations is, on the one hand, disturbing and, on the other, disgusting. One wonders why it does not get in to the heads of the Pakistani rulers that peace in the region will benefit all.

    Pakistan certainly will benefit more than India by conserving its financial resources to improving the lot of the massive population that suffers because of poverty, malnutrition and disease. Imagine, the two countries in trying to maintain military power balance, have deprived their populations of the fruits of development. Imagine, the money saved on arms and ammunition and ploughed in to building infrastructure and educational and health facilities that the vast numbers are deprived of.

    When will it occur to leaders on both sides that they can truly be great nations if only they realized the benefits of peace? Without a moment’s hesitation, I am prepared to blame Pakistan government more than the Indian government for the sorry state of affairs in both the countries, the people of which had until the partition of the country in 1947 lived as brethren for hundreds of years. I am confident that majority of people in both the countries want to have friendly relations and they realize the importance of peace in the region for their well being and prosperity.

    It is only a small minority that keeps the pot of hatred boiling. It suits them. However, India must tell Pakistan -thus far and no farther. No nation can allow its people, particularly soldiers, to be beheaded or killed in dastardly attacks. No nation worth its salt could allow a neighbor to continue to abuse. The recent killing of Indian soldiers without any provocation is deplorable and condemnable. If Pakistan government were sensible it should have immediately apologized for the killings and taken the perpetrators of the heinous crime to task.

    Mrs. Sadhna Shanker arrived in New York only a couple of days ago after giving sleepless nights to her husband who felt compelled to compose poems assuring himself that she was on her way and would soon be with him.     Maragos projects $5.6M surplus for Nassau

    HICKSVILLE, NY (TIP): County Comptroller George Maragos on Wednesday, August 7, projected Nassau will end the year with a $5.6- million cash surplus, primarily because sales taxes are coming in higher than projected, says a Daily News report.

    However, Maragos said he expected the county’s financial control board, the Nassau Interim Finance Authority, to determine that Nassau will finish 2013 with a $119.6 million deficit because the control board discounts one-time cash payments and other nonrecurring revenues. Maragos in his midyear budget report projects a surplus even though he expects the county to use operating funds, instead of borrowing, to pay $30 million in police termination costs and $35 million in property tax refunds.

    County Executive Edward Mangano had proposed borrowing to pay both expenses, but a spokeswoman said Wednesday the administration is open to further discussions. “The county economy has been able to rapidly recover from superstorm Sandy and continues to grow faster than neighboring counties and the national economy,” Maragos said in a news release. “This economic growth has increased sales tax revenues . . . while the administration has kept a tight rein on costs.”

    Maragos projects an overall 7.2 percent increase in sales tax revenues this year over last, compared with a less than 5 percent increase included in Nassau’s current $2.8 billion budget. But NIFA member Chris Wright said, “It’s not a surplus unless revenues, which don’t include borrowing, exceed expenditures. And it doesn’t sound like that’s going to happen. In fact, it appears that the deficit will once again be a multiple of our control-period trigger amount.”

    State law calls for NIFA controls when the county’s deficit exceeds 1 percent of its budget. The county charter directs Maragos to prepare a midyear budget report by the end of July. Maragos’ spokesman Jostyn Hernandez said the report was delayed because of changing budget risks following recent borrowing decisions by NIFA and the county legislature. “George Maragos’s creative accounting cannot hide the truth that the county’s finances are in crisis,” said former Nassau County Comptroller Howard Weitzman, a Democrat challenging Republican Maragos’s re-election bid this fall. “This report is late and laughable.”

    LOS ANGELES, California (TIP): A thousand Californian firefighters are battling a blaze east of Los Angeles that has injured five people and forced 1,800 to flee their homes, authorities said on august 8. Those hurt in the fire — estimated to cover 10,000 acres (4000 hectares) — include four firefighters and a civilian, the Riverside County fire department said.

    The civilian victim was wounded Wednesday and airlifted to a burn center, Fire chief John Hawkins told reporters. Fifteen buildings were destroyed in the city of Banning, 90 miles (150 kilometers) east of Los Angeles, officials said. Thirteen helicopters and six planes are in use to fight the fire, which is only 10% contained and has sparked the evacuation of 1,800 people in several towns near Banning.

    Authorities have not determined what sparked the flames. Smoke has reached the international airport of Palm Springs, but the runways remain open, director Tom Nolan told reporters. The effort to douse the flames is being complicated by high temperatures, very low humidity and wind gusts, weather forecasters said.

    NEW YORK (TIP): Indians chasing the American dream have reason to cheer. In 2012, as many as 35,472 Indians with H- 1B visas got green cards, up from 6,000 in 2011 – accounting for more than 50% of all green cards issued to H-1B holders for all countries in the year.

    The data from the US Citizenship and Immigration Services (USCIS) comes in the wake of a new Bill that focuses on attracting knowledge workers to the US by providing them citizenship. The common impression is that the US is increasingly trying to keep foreigners out with new immigration walls. But that’s only a partial truth; it pertains to less skilled overseas workers. In reality, the US is also trying to attract the best brains from around the world and among the biggest beneficiaries are talented Indians.

    A green card allows a person to live and work anywhere in America, and is a path to citizenship. An H-1B visaholder is beholden to the employer who hired him or her, and can be deported unless the holder can find another H-1B sponsor. Most Indians who got green cards in 2012 came from the EB-2 category, which includes professionals with advanced degrees in STEM (science, technology, engineering and math).

    Clearly, the US wants to retain its competitive edge and accelerate R&D. “They need people with specialized skills who can substantially contribute to the knowledge economy. The large base of Indians with advanced degrees and domain expertise is highly sought after and given preferential treatment,” said Rakesh Prabhu, partner, immigration practice, ALMT Legal. The number of green cards a country gets in a year cannot exceed 7% of the total available. The limit primarily restricts those born in India, China, Mexico and the Philippines, given the large numbers of applicants from these countries.

    However, most of the rest of the world does not come anywhere close to this quota. The unused numbers in a year from other countries are often given to countries that have long queues. In 2012, India appears to have benefited. “The US visa office seeks to use the available visa numbers by the time the fiscal year ends, at the end of September. They don’t like to waste numbers. So there could be a new surge (Indians becoming eligible for green cards) in August 2013 and in subsequent months,” said Cyrus D Mehta, managing attorney and founder of the New York-based law firm Cyrus D Mehta & Associates.

    Now, there’s a serious effort to remove country quotas, which has a broad agreement among Republicans and Democrats. The Comprehensive Immigration Bill, which is before the Senate, seeks to remove the country caps to attract the best minds to the US. The political consensus right now is that knowledge workers with permanent residency are valuable to the economy. “If Congress removes country quotas, it should help Indian citizens. However, it will affect the rest of the world adversely,” said Denyse Sabagh, partner in the Philadelphia-headquartered law firm Duane Morris.

    NEW YORK (TIP): As a security alert kept millions on edge throughout the Muslim world, suspected U.S. drone attacks in Yemen killed 12 alleged militants Thursday, August 8, and Saudi security forces arrested two foreign men they say were plotting suicide attacks in the region, a Los Angeles Times report says.

    The drone strikes and the arrests in Saudi Arabia of a Yemeni and a Chadian — reported to have issued “messages of incitement and hatred” through social media — reflected the intense vigilance pervading police and military forces across the Middle East, Africa and South Asia at the end of the Muslim holy month of Ramadan. The three drone strikes in Yemen brought the total since July 27 to eight and the death toll to 34.

    The stepped-up pace of targeted killings may be thinning the ranks of Al Qaeda-aligned extremists, but it has also intensified anger among Yemeni citizens who consider the aerial bombardments a violation of their sovereignty and a reckless practice that at times kills innocents. The latest drone strikes were reported by the Yemen Post, among other media, which took note of the growing public alarm over the rockets fired from unmanned aircraft. Yemeni authorities tolerate the strikes as they work with U.S.

    special forces to drive out Al Qaeda-affiliated militants who took refuge in the mountainous hinterlands two years ago, when the country was racked by widespread protests against then-President Ali Abdullah Saleh. The autocrat who ruled for more than 30 years was forced out early last year and replaced by Abed Rabbo Mansour Hadi, who has collaborated with U.S. forces in a campaign to eradicate the strongholds where terrorists train and plot attacks on Western targets.

    Counter-terrorism efforts have been directed at Yemen in recent days because of intercepted militant “chatter” that suggested terrorist attacks were being plotted between the head of the global Al Qaeda network, Ayman Zawahiri, who is believed to be in Pakistan, and its Yemeni affiliate, Al Qaeda in the Arabian Peninsula. Intelligence sources have said that Zawahiri has deputized AQAP leader Nasser Wuhayshi to carry out plots against U.S. and Western citizens and interests in connection with Wednesday’s end of the Muslim holy month of Ramadan and the Eid al-Fitr holiday.

    The U.S. State Department issued a worldwide terror alert Friday and closed more than 20 embassies and consulates in the Muslim world to protect its staff in the event of an attack. American diplomats based in Yemen’s capital, Sana, were evacuated from the country Monday, as were British and French nationals. Yemeni security officials reported Wednesday that they had foiled an Al Qaeda plot to seize two port cities on the Gulf of Aden and blow up pipelines and other vital oil infrastructure.

    Few details were disclosed by authorities, and the claimed thwarting of the attack did little to ease fears of impending violence in the region. On Thursday, the Saudi Press Agency reported the arrest of two men it said had “recruited themselves” and discussed via social media plans to launch suicide operations. Neither the nature nor the targets of the alleged plot were disclosed.

    In addition to the religious holiday, this week marks the 15th anniversary of the Aug. 7, 1998, synchronized bombings of U.S. embassies in Kenya and Tanzania, which killed 223 people and wounded more than 4,000. The attacks were the first major demonstration of Al Qaeda’s ability to carry out coordinated operations on multiple targets, a hallmark of its strategy that was seen again three years later on Sept. 11, 2001.

    WASHINGTON (TIP): Relations between the United States and Russia deteriorated further on Wednesday, August 7 when Barack Obama abandoned a presidential summit with Vladimir Putin that was due to be held next month, amid fury in Washington over Moscow’s decision to grant asylum to the NSA whistleblower Edward Snowden.

    US President Barack Obama has canceled his scheduled visit to Moscow to meet his Russian counterpart Vladimir Putin, as tension builds up between two countries over fugitive intelligence leaker Edward Snowden.

    The mini-summit had been scheduled for early September, days before the G-20 meeting of world economic leaders in St. Petersburg, Russia. Obama still plans to attend the main G-20 summit. Authorities in Moscow last week granted temporary asylum to Snowden, who is wanted by U.S. authorities for leaking classified intelligence information to newspapers. That decision infuriated Washington. Sen. John McCain, R-Ariz., called on the U.S. “to fundamentally rethink our relationship with Putin’s Russia.”

    In a statement Wednesday, the White House noted cooperation in some areas, such as policies toward Afghanistan and Iran, but said Moscow’s decision to help Snowden was “disappointing.” “Given our lack of progress on issues such as missile defense and arms control, trade and commercial relations, global security issues, and human rights and civil society in the last twelve months, we have informed the Russian Government that we believe it would be more constructive to postpone the summit until we have more results from our shared agenda,” the White House said. Senator Charles E. Schumer, who had urged Obama to cancel the summit, welcomed the White House decision. State Department spokeswoman Jen Psaki said the decision to abandon the summit was made after a unanimous decision by the White House national Security Council.

    A meeting between defense secretary Chuck Hagel, secretary of state John Kerry and their Russian counterparts will go ahead in Washington on Friday as planned. In a separate announcement, the White House said Obama will visit Sweden instead, traveling to Stockholm the day before the St Petersburg summit. “Sweden is a close friend and partner to the United States,” it said in a statement. “[It] plays a key leadership role on the international stage including in opening new trade and investment opportunities.” Speaking on Tuesday night, Obama said he was disappointed that Russia had allowed Swowden to stay instead of sending the former government contractor back to the US to face espionage charges.

    In his first direct comments about Snowden since Russia’s decision last week, the president said the situation reflected “underlying challenges” in dealing with Moscow. “There have been times where they slip back into cold war thinking and a cold war mentality,” Obama said on NBC’s Tonight Show. The decision to cancel the meeting was greeted with little surprise in Moscow, where analysts and lawmakers have been predicting such a step.

    Presidential aide Yuri Ushakov said the Kremlin was disappointed that Obama cancelled the meeting with Putin, state news agency RIANovosti reported. “It’s obvious that this decision is connected to the situation with the American intelligence services employee Snowden, which was not created by us,” he said.

    NEW DELHI (TIP): Hours after Defence Minister A K Antony backtracked from his earlier statement in Parliament and squarely blamed the Pakistan Army for carrying out the attack on the Line of Control that killed five Indian soldiers, Pakistan Prime Minister Nawaz Sharif provided an “escape route” to the beleaguered government.

    Sharif, who had a briefing in the Pakistan Foreign Office on Thursday, expressed “sadness” over the loss of human lives and made it clear to his officials that it was “incumbent upon the leadership of both sides not to allow the situation to drift and to take steps to improve the atmosphere by engaging constructively with a view to building trust and confidence”. He went on to add that it was “imperative” for both sides to “take effective steps to ensure and restore the ceasefire on the Line of Control”.

    Military-to-military channels should be more “optimally utilized to prevent misunderstandings and not allowing the situation to escalate”. Further, Sharif suggested that both sides must also look to identify more measure to strengthen existing mechanisms at political and military levels. “The Prime Minister said that he was looking forward to his meeting with Prime Minister Manmohan Singh on the sidelines of the United Nations General Assembly in New York. During the meeting, we will discuss steps to further build trust and consolidate this relationship, the Prime Minister added,” stated a Pakistan Foreign Office release.

    But Sharif’s efforts to calm tempers were in stark contrast to the mood in New Delhi, where the government went back to adopt the hard line that it had first tried to avoid. Under pressure from the Opposition, Antony on Thursday made a second statement based on what he said was Army Chief Gen Bikram Singh’s feedback after visiting the scene of the killings. “Since then the Chief of the Army Staff has visited the area and has gone into the details of the matter, it is now clear that the specialist troops of Pakistan Army were involved in this attack when a group from the Pakistan Occupied Kashmir (PoK) side crossed the LOC and killed our brave jawans. We all know that nothing happens from Pakistan side of the Line of Control without support, assistance, facilitation and often, direct involvement of the Pakistan Army,” Antony told Parliament.

    This was a clear reversal of the UPA’s earlier stand that the attack was carried out by terrorists and some people in Pakistan Army fatigues. Antony sought to justify this change of stance by saying the earlier statement to Parliament was based on “fact as we knew them at that point of time”. Going beyond this, the Defence Minister linked this attack to the brutal killing of two Indian soldiers, one of whom was beheaded, earlier this year as well as the 26/11 attacks while claiming that the perpetrators will not be spared. “Those in Pakistan who are responsible for this tragedy and the brutal killing of two soldiers earlier this year should not go unpunished.

    Pakistan should also show determined action to dismantle the terrorist networks, organisations and infrastructure and show tangible movement on bringing those responsible for the Mumbai terrorist attack in November 2008 to justice quickly,” he said. As he made these connections, it became clear that the government had to also promise subsequent action on the lines of what had been done when each of these earlier incidents took place. Antony did so by linking this to the overall dialogue process and committing before Parliament that there will be consequences. “Naturally, this incident will have consequences on our behaviour on the Line of Control and for our relations with Pakistan.

    Our restraint should not be taken for granted, nor should the capacity of our Armed Forces and resolve of the Government to uphold the sanctity of the LC ever be doubted.” With the Defence Minister making amends, the BJP was more generous with praise. “I thank the Defence Minister for rectifying the mistake which he had made,” Leader of Opposition Sushma Swaraj said, adding “such a mistake should not be repeated.” The Rajya Sabha was adjourned due to an uproar barely after Antony began speaking. Deputy Chairman P J Kurien disallowed members from asking questions on the ground that Antony could not complete his statement nor had he allowed him to table it. Minister of State for Parliamentary Affairs Rajeev Shukla clarified later, “We will again request the Defence Minister to clarify…On Monday he will make the statement in the House again.”

    JAMMU (TIP):In a deadly crossborder attack, five Indian Army personnel were killed and a sixth was injured by a group which the government said comprised “20 heavily armed terrorists along with persons dressed in Pakistan army uniforms” near the Line of Control (LoC) early on August 6 morning.

    The incident comes days after Pakistan expressed a desire to resume the stalled peace talks with India and a meeting between Prime Minister Manmohan Singh and his counterpart Nawaz Sharif was being fixed. The attack occurred at the Chakkan Da Bagh area in Poonch, which is a border trading point, in the early hours of Aug 6 when six Indian Army personnel were patrolling the LoC, several hundred metres ahead of the border fencing but 450 metres within the Indian side of the boundary.

    In his statement in Parliament, Defence Minister A K Antony said the men were ambushed on “our side of the LoC”, but stopped short of blaming regular Pakistan army

    troops for the attack. “The ambush was carried out by approximately 20 heavily armed terrorists along with persons dressed in Pakistan army uniforms,” he said. This was at variance with the Army’s statement which said the attack was carried out by terrorists “along with soldiers of Pak army”.

    The Army also said the attack was carried out by a “Pak Border Action Team”. However, within hours, the Army’s statement was revised to reflect what Antony had said in Parliament, to the effect that “persons dressed in Pakistan army uniforms” took part in the attack. No explanation was given for the revision. But Army sources backed the original statement, saying that soldiers of Pakistan’s 801 Mujahid battalion took part in the attack along with militants. “It was a well-planned and coordinated attack that clearly involved regular troops of the Pakistan army.

    It was a Pakistan Border Action Team (BAT) that executed the attack,” said these sources. Pakistan, meanwhile, denied the involvement of its troops. A PTI report from Islamabad quoted Foreign Office spokesman Pak troops Aizaz Chaudhry as saying that “these are baseless and unfounded allegations”. According to sources, the attack took place at a time when the 21 Bihar Regiment was in the process of handing over charge of its area of responsibility to the 14 Maratha Light Infantry (MLI) in Poonch.

    The time of handing over charge is considered vulnerable as Pakistani troops are known to target battalions that are being inducted before they get familiarised with the terrain. The patrol originated from the Cheetah post and was going along the LoC when it came under attack. Of the five personnel who were killed in the ambush, four belonged to the 21 Bihar Regiment — Naik Prem Nath Singh, Lance Naik Shambu Singh, Sepoy Vijay Kumar Roy and Sepoy Raghunandan Prasad — while the fifth, Sepoy Pundlik Mane, was from Maratha Light.

    The sole survivor of the attack, Sambhaji Kute, is from 14 MLI. While he was injured in the attack, Kute is said to be out of danger and has told his superiors that the patrol came under heavy fire from several directions while it was moving along the LoC. “A changeover of troops was in progress in Poonch and the advance party of the 14 MLI that was to take charge was being familiarised with the Sarla battalion area,” confirmed officials. Army Chief General Bikram Singh is expected to reach Poonch tomorrow and is likely to visit the area to take stock of the situation.

    It is unclear why Antony was guarded in his statement in parliament and did not directly name the Pakistani Army. In January, following an attack on Indian troops in Mendhar when one soldier was beheaded and mutilated, Antony had clearly said that the “Special Services Group of Pakistan Army” had executed the attack. Antony also told parliament that India has lodged a “strong protest with the Pakistan government through diplomatic channels” and said the Army is “fully ready to take all necessary steps to uphold the sanctity of LoC”.

    The minister said the number of infiltration attempts on the LoC have doubled this year as compared to the same period in 2012, adding that 57 ceasefire violations have taken place, which is 80 per cent more than last year. “The Indian Army successfully eliminated 19 hardcore terrorists in the recent months of July and August along the LoC and in the hinterland in J&K. The effective counter infiltration grid on the LoC has ensured that 17 infiltration bids were foiled this year,” he said. The Army statement also said the action is a “likely consequence of frustrations of the terrorists’ tanzeems and Pak Army due to successful elimination of 19 hardcore terrorists in the months of July and August in J&K.” It added that the “Pak Army’s desperation is also evident in the substantial increase in the number of ceasefire violations this year”.

    ROME (TIP): Italy’s supreme court on August 1 upheld a jail sentence against Silvio Berlusconi for tax fraud in a devastating blow to the former prime minister that could throw the country’s fragile coalition government into crisis. The former cruise ship crooner is Italy’s most colorful and scandal-prone figure but it was his first definitive conviction in up to 30 court cases on charges ranging from fraud and corruption to having sex with an under aged prostitute.

    After a three-day hearing, the five judges of the supreme court rejected Berlusconi’s final appeal against the verdict handed down by two lower courts in Milan which sentenced the media mogul to four years in jail – commuted to one year under an amnesty. But the top judges ordered a review by a Milan court of the second part of his sentence, a five-year ban from public office. This will enable him to remain as a Senator and as leader of his center-right People of Freedom Party (PDL) for the moment.

    Berlusconi, a 76-year-old billionaire who has dominated politics for 20 years, was convicted over the fraudulent purchase of broadcasting rights by his Mediaset television empire. Because of his age he is likely to serve the sentence either through community service or under house arrest. He accuses leftist magistrates of relentlessly trying to remove him from politics since he stormed onto the scene in 1994 after a corruption scandal wiped out the old order.

    The verdict could not only mark the twilight of his long career but destabilize the three-month-old government of Prime Minister Enrico Letta and potentially send tremors across the euro zone. The bloc’s third-largest economy is ruled by a fractious coalition of Letta’s center-left Democratic Party (PD) and Berlusconi’s PDL. President Giorgio Napolitano, architect of Letta’s coalition after a two month hiatus following inconclusive elections in February, quickly issued a statement urging calm and national cohesion.

    He called for trust and respect for the judiciary. Letta made no comment but his spokesman referred to a previous statement on the case in which he had said judicial issues must remain separate from politics and there was no danger of a political “earthquake.”

    Danger of political turmoil
    Berlusconi, Italy’s longest serving premier, has repeatedly said the government must not fall whatever the verdict but PDL hawks had called for a mass walkout of its ministers and public protests including blocking motorways if he was convicted.

    His supporters demonstrated outside his central Rome home before the verdict, disrupting traffic. A greater threat to the government could come from the faction-ridden PD, many of whose members are already unhappy with ruling in coalition with Berlusconi’s party and could rebel following his first definitive conviction. The divisions over the case were immediately apparent in the first comments from politicians on the left and right. Luca d’Alessandro, head of the PDL parliamentary justice commission said: “This country used to be famous as the cradle of law.

    Today it has become its tomb, run by a corporation of grave diggers in gowns who have carried out the perfect crime.” But the leader of Letta’s PD, Guglielmo Epifani said, “The sentence has to be respected and carried out.” Beppe Grillo, leader of the populist 5- Star Movement that stunned mainstream politicians by taking a quarter of the vote in the February poll, hailed the sentence on his blog: “The verdict is like the fall of the Berlin Wall in 1989.” Investors have hitherto shown little concern, with the main barometer of market confidence, the spread between Italian 10 year bond yields and their safer German counterparts, at 270 basis points, well below levels seen during earlier crises. But markets were closed before the verdict came out.

    Napolitano and Letta are adamant that Italy cannot afford more instability as it struggles to climb out of its worst postwar recession. Berlusconi’s chief lawyer, eminent supreme court specialist Franco Coppi, told the judges on Wednesday that the lower courts had wrongly framed the charges against him. He said even if the offence were proved, it was a huge tax evasion scheme using legal loopholes rather than fraud. There has been speculation that Berlusconi’s oldest daughter, Marina, 46 and chairwoman of his Fininvest holding company, could become the PDL’s figurehead if he was convicted.

    Both major parties may be reluctant to precipitate an election that might produce an even more chaotic result than the February vote in which Grillo surged to prominence. But the verdict could add to inertia which has prevented Letta’s fractious government from passing urgently needed economic reforms. The supreme court decision is not Berlusconi’s only legal headache. He is also appealing in a lower court against a sevenyear jail sentence imposed in June for abuse of office and paying for sex with Moroccan-born nightclub dancer Karima El Mahroug, alias “Ruby the Heartstealer” when she was underage.

    CLEVELAND: The man convicted of holding three women captive in a house he turned into a prison and raping them repeatedly for a decade was sentenced August 1 to life without parole plus 1,000 years. Ariel Castro, 53, apologized to his victims in a rambling, defiant statement before he was sentenced. He blamed a sex addiction, his former wife and even the FBI for not thoroughly investigating the abductions while claiming most of the sex was consensual and that the women were never tortured.

    “These people are trying to paint me as a monster,” he said. “I’m not a monster. I’m sick.” Just before the sentencing, one of three women he kidnapped stood within feet of Castro and told him his life was over. “You took 11 years of my life away and I have got it back,” said Michelle Knight. “I spent 11 years in hell. Now your hell is just beginning.” Knight, 32, was the first woman Castro abducted in 2002 after he lured her into his house with the promise of a puppy for her son. Relatives of the other two victims spoke on their behalf.

    Judge Michael Russo dismissed Castro’s claims that the women lived a happy life with him. “I’m not sure there’s anyone in America that would agree with you,” he said. Castro pleaded guilty last week to 937 counts including aggravated murder, kidnapping, rape and assault. A deal struck with prosecutors Friday spared him from a possible death sentence for beating and starving a pregnant victim until she miscarried. The judge told Castro that there was no place in the world for people who enslave others. “These women never gave up hope,” Russo said. “In fact, they prevailed.” As Castro was led away, Knight watched, smiling.

    Thursday’s hearing gave prosecutors a chance to detail some of Castro’s assaults and law enforcement a chance to describe the jury-rigged prison he built in his ramshackle home. FBI agent Andrew Burke said Castro created a makeshift alarm system and chained the women inside bolted bedrooms. Bedroom windows were boarded shut from the inside with heavy closet doors and doorknobs had been removed and replaced with multiple locks, he said. The house was divided in ways to make it more secure and to hide the existence of rooms, he said.

But certainly we are very supportive of the moves that both India and Pakistan have made to normalize relations,” he added. “I think that the great strides in normalization on the economic side have been very important the last few years and have really paved the way for better and more constructive conversations on the political side.

    So we’ll see where that continues to lead.” Kerry during his June trip to India called on the Indians to continue that process of fa cilitation, as well as the Pakis tanis to do things like provide most favored nation status to the India, the official said.

    NEW YORK (TIP): Sandeep Aggarwal, 40, a former analyst for San Franciscobased Caris & Co., who was arrested by FBI agents Monday, July 29, at his home in San Jose, California, was released on $500,000 bail in federal court Tuesday, July 30according to San Jose Mercury News. He has been charged with providing insider information about a deal between Microsoft and Yahoo to a prominent hedge fund.

    He is scheduled to appear before a New York court Friday, August 2. Aggarwal, who also has a home in Gurgaon, in India’s Haryana province, is accused of leveraging his tech industry contacts and then providing confidential insider information about a 2009 advertising and Internet search agreement between Microsoft and Yahoo to SAC Capital Advisors and a second unidentified hedge fund that same year.

    Announcing conspiracy charges against Aggarwal, Manhattan’s IndianAmerican US attorney Preet Bharara said: “As alleged, Sandeep Aggarwal leveraged his contacts in the technology industry to obtain an illegal edge in the form of inside information about a highly anticipated development, and then lied about his criminal conduct.” According to the complaint unsealed in Manhattan federal court, on the evening of July 9, 2009, Aggarwal learned from a friend who was an employee of Microsoft that discussions about the partnership had recommenced and that a transaction was likely within the next few weeks.

    The next day, Aggarwal provided information about the partnership to at least two different hedge funds, including to Richard Lee, then a portfolio manager at SAC Capital Advisors LP. On July 10, 2009, Aggarwal told Lee, in substance, that he had heard from a source-whom Aggarwal described as “a senior guy at Microsoft” that the success of Microsoft’s Bing search engine had caused Yahoo to move closer to Microsoft’s offer and it was likely that the deal could be announced within the next two weeks.

    Thereafter, Lee’s hedge fund purchased several hundred thousand shares of Yahoo stock, and Lee purchased 25,000 shares of Yahoo stock in his personal account, it alleged. Aggarwal is charged with one count each of conspiracy to commit securities fraud, which carries a maximum sentence of five years in prison, and conspiracy to commit wire fraud, which carries a maximum sentence of 20 years in prison. Richard Lee pled guilty July 23, to a criminal information charging him with one count of conspiracy and one count of securities fraud in connection with insider trading between April 2009 through 2010, while he was employed by SAC Capital Advisors LP.

    Mercury News said July 17 Aggarwal sent an email to it saying that he had moved to India 20 months earlier to create India’s first and largest managed marketplace called ShopClues.com. “We are currently the fastest growing E-Commerce company in India,” Aggarwal wrote to the paper. “We have a total of 360 employees and perhaps the strongest team executing on the ground in India.”
